The Subject Of Procurement Is The Provision Of Energy Services To The Customer (User) By The Energy Service Provider (Selected Provider, Hereinafter: The Provider) For The Purpose Of Improving The Energy Efficiency Of The Building, Which Implies Achieving And Maintaining A Guaranteed Level Of Energy Efficiency, I.E. Guaranteed Energy Savings To Which The Provider Obligates With Its Offer (Hereinafter: Offer) In Relation To The Reference Values Listed In The Attachment (Annex 2 - Reference Values) Of This Procurement Documentation, In Accordance With The Conditions Of This Procurement Documentation. The Energy Service Provider Guarantees That, With Its Own Investments, It Will Achieve And During The Contractual Period Maintain The Guaranteed Level Of Improvement Of The Buildings Energy Properties (Energy Efficiency) Compared To The Reference State Before The Initiation Of This Public Procurement Procedure, And The Client (User) Will Pay The Fee For The Energy Service During The Contractual Period Which Is Based On A Guaranteed Level Of Energy Efficiency, That Is, On Guaranteed Savings On Energy Costs And Energy-Related Costs. The Energy Service Consists Of The Implementation Of The Following Measures: - Design - Preparation Of Project Documentation (Project) For Improving The Energy Efficiency Of The Building, - Energy Renovation - Construction For The Purpose Of Implementing Energy Efficiency Measures In Accordance With The Project, - Expert Construction Supervision - Construction Supervision In Relation To Compliance Of The Construction With The Project, The Construction Act, Special Regulations And Rules Of The Profession, - Energy Certification - Implementation Of An Energy Audit And Issuance Of An Energy Certificate After The Energy Renovation Of The Building, - Monitoring - Monitoring Of The Implemented Measures Energy Efficiency, Monitoring Of Energy And Water Consumption, Monitoring Of Conditions Of Use (If The Bidder Has Committed To Monitoring Conditions Of Use With His Offer), And Maintenance Of Epc Assets In Accordance With The Provisions Of The Agreement. In Order To Remove Any Doubt, It Is Clarified That The Subject Of Procurement Is Not Works And Services In Construction, Nor The Delivery Of Goods, But The Subject Of Procurement Is The Provision Of Energy Services For The Purpose Of Energy Renovation Of The Building Based On A Long-Standing Public Procurement Contract (Contract On Energy Performance) In Which The Energy Service Provider , In The Role Of An Investor On Someone Elses Property, Invests Its Own Funds And Assumes The Majority Of The Risks Of Implementing That Contract. A More Detailed Explanation Of The Service In Question, The Terms Used, The Conditions And The Way Of Performing The Service In Question, Is Specified In The Form Of The Agreement. The Contract Form Is Attached (Annex 4 - Contract On Energy Performance) To This Procurement Documentation. By Performing The Service In Question, The Provider Undertakes, With Its Own Investments, To Achieve And During The Contractual Period To Maintain The Guaranteed Level Of Energy Efficiency Of The Building To Which It Committed Itself In Its Offer, I.E.
