The Federal Chamber confirmed the prosecution of eleven individuals and two construction companies, including Lemiro Pablo Pietroboni SA and Luis Losi S.A., in a case for alleged payment of bribes , fraud against the State , and falsification of documents in the execution of road works. The resolution, signed by judges Martín Irurzun , Eduardo Farah, and Roberto Boico, also ratified a total embargo of $632,381,436 on the accused firms. This is one of the first major cases to apply the Law on the Criminal Liability of Legal Entities (Law 27,401, passed in 2017), which allows for private companies to be criminally prosecuted for acts of corruption. This case investigates the direct benefits that construction companies allegedly received through overpricing and irregular bidding, beyond the individual actions of their executives. Among the main defendants are Gabriel Pedro Losi , Maximiliano Pietroboni , and Jorge Horacio Fernández , linked to the eponymous construction companies, historically active in public works in Entre Ríos and other provinces. According to the case, the criminal scheme consisted of declaring higher than actual project volumes, especially on sections of National Route 19 in Córdoba, and then distributing part of these overprices in bribes through companies linked to officials. Judge Sebastián Casanello, in charge of the investigation, reconstructed the operation based on technical reports, expert reports, and statements from key witnesses, including a state auditor who detected irregularities in payments and a construction inspector who refused to falsify documentation. The latter reported pressure from his superior, Guillermo Crisci, former coordinator of the Works Department of the National Highway Administration (DNV), who was also prosecuted.
