The Second Environmental Court dismisses the claims seeking to annul the admission resolutions of the Metropolitan Region Environmental Assessment Commission. The Second Environmental Court has announced the rejection of two claims seeking to annul the resolutions of the Metropolitan Region Environmental Assessment Commission that approved the 10.66 MWp El Roque and 9.58 MWp Doña Petronia photovoltaic projects, both to be located in the commune of Padre Hurtado, Talagante province. The Court has decided to dismiss the claims of the claimant Arnhild Dyrhaug Odfjell and Odfjell Vineyards SA, who argued that the photovoltaic projects should have been subject to environmental assessment through an environmental impact study (EIA) and not as a declaration (DIA), due to a potential impact on the health of the population - due to its proximity to the claimants house -, particularly due to the emission of noise, vibrations and atmospheric emissions, together with having failed to assess the synergistic impacts of the other photovoltaic projects surrounding said property, as explained in an official communication. The El Roque photovoltaic park project is planned to supply 19,656 photovoltaic modules to the local distribution grid, part of the National Electric System (SEN), for a total installed capacity of 10.66 MWp. This park, a development by Solek Chile with an estimated investment of $10 million, was approved by the Environmental Impact Assessment Service (SEIA) in January 2022. The Doña Petronia photovoltaic park project, for its part, proposes 18,088 530 Wp photovoltaic panels, for a total capacity of 9.58 MWp, presented under the Small Distributed Generation Means (PMGD) regime. Promoted by IM2 Solar Chile, it envisages an investment of $11 million. The project had obtained environmental approval from the SEIA (Security and Environmental Protection Agency) in March 2022. |
