Work Detail The Ministry of Infrastructure has issued a call for public tenders. The Government of the City of Buenos Aires is resuming work to complete the construction of the Federal Penitentiary Complex VII – Ricardo Gutiérrez Locality, Marcos Paz District, reports Public Works Tender / Call No. 45/DGTALMI/24 published in the Buenos Aires Official Gazette. The Ministry of Infrastructure has issued a call for public tenders to contract the work “Completion and Finishing of the Federal Penitentiary Complex VII – Ricardo Gutiérrez Locality, Marcos Paz District – Stage 4”. The opening of bids will be held on November 8. “The specifications and other documentation governing this call are “confidential”. They may be obtained free of charge by potential bidders” for which they must go to the Operational Management of Purchases and Contracts and Public Works Processes, of the Technical, Administrative and Legal General Directorate dependent on the Ministry of Infrastructure, located at Av. Martín García 346, 5th Floor, CABA, from Monday to Friday from 11 a.m. to 4 p.m., to acquire said documentation in digital format, and must accompany the Affidavit of Confidentiality which will be duly communicated by Circular”, indicate official sources. The Council of the Judiciary of the CABA reviewed the background: "Based on the adoption of the commitment between the National State and the Autonomous City of Buenos Aires to move the Federal Penitentiary Complex of the CABA (CPFCABAVilla Devoto), on March 12, 2018 a Framework Agreement was signed between the Ministry of Justice and Human Rights of the Nation, the Government of the Autonomous City of Buenos Aires and the State Property Administration Agency, ratified on June 7, 2018 by the Legislature of the Autonomous City of Buenos Aires by Resolution No. 100/2018, the purpose of which was to establish joint and coordinated actions in view of the public interest of this Government in the transfer of the so-called "Devoto Complex", in order to favor the integral urban development of its current location, through a joint plan with the National State. The Framework Agreement provided for various joint actions, mainly the construction of a new Penitentiary Complex by the Government of the Autonomous City of Buenos Aires, with the participation of the Ministry of Justice and Human Rights of the Nation, the State Property Administration Agency (AABE) and the Ministry of Urban Development and Transportation of the Autonomous City of Buenos Aires in its alternatives and missions and functions. The new Penitentiary Complex is being built on the property cadastrally named as District III, Parcel 191d, Rural Section, with a surface area of ??one hundred and twenty (120) hectares in the district of Marcos Paz, in the Province of Buenos Aires. A report from the Magistracy from April 2023 stated: “The average state of conservation of the buildings and facilities in general of what has already been built could be verified, likewise a large number of construction elements scattered inorganically throughout all the modules can be observed, with maintenance tasks having to be carried out in some places that show some deterioration. There are missing works in all buildings that involve the areas that make up the standards for the execution of good art in prison construction. Likewise, the quality of the materials used could not be verified, observing at first glance and as an example that Durlock panels were used to cover ceilings in common circulation areas that will have transit of housed people. We are verbally informed by personnel on site that the work is currently paralyzed by the Government of the City of Buenos Aires and the contractor company, with only security and night watch personnel, as they are responsible for the precarious possession of the work until it is delivered to the Ministry of Justice and Human Rights of the Nation. It is estimated that the total and general work is 60/70% complete for its completion with "turnkey" and that there is, prior to the restart of the work, an evident need to carry out maintenance work in the existing modules, estimating the contracting firms that in order to finish it it would be necessary to have a minimum time of 18/24 months to complete it. carry out works, equip and tune up security systems.” The Buenos Aires City government announced in May of this year that it was resuming construction of the Federal Penitentiary Complex VII in the context of the crisis caused by the overcrowding of prisoners in Buenos Aires police stations and jails. In May of this year, it also declared for a period of 12 months "the emergency of buildings, infrastructure and accommodation conditions in police stations and penal institutions for temporary and transitory accommodation for persons deprived of their liberty in the territory of the CABA." The intention had been announced to install 57 detention modules, in three areas, with the capacity to house 300 detainees: each of the groups of 19 rectangular modules will be located in yards or parking lots within police stations: in Communal 12, Ramallo 4398 (Saavedra); in Communal 15, Guzmán 396 (Chacarita); and in Vecinal 4D, California 1850 (Barracas). At the same time, a central jail is being built in Villa Soldati (Conuna 8). In April of this year, the Ministry of National Security, through Resolution 254/2024 published in the Official Gazette of the Argentine Republic, extended the “penitentiary emergency” for two more years and criticized the City of Buenos Aires because the Marcos Paz Penitentiary Complex that was to replace the Federal Penitentiary Complex of the CABA of Villa Devoto (Commune 11) is not ready. It also stressed that “the transfer of ordinary justice in criminal matters to the scope of the City has not yet been completed.” That week, Buenos Aires City Security Minister Waldo Wolff had blamed the national government for prison escapes and overcrowding in police stations and jails in the city. In the recitals, the ministry headed by Patricia Bullrich stated that "of the 11,453 people housed in the Federal Penitentiary Service, 54.88% are convicted persons and 45.10% are detained as defendants." “In addition, another 4,265 persons deprived of liberty are awaiting admission, according to the following details: 154 detainees in Argentine National Gendarmerie facilities; 212 detainees in Argentine Federal Police; 17 detainees in Airport Security Police; 3 detainees in Argentine Naval Prefecture; 16 detainees in Buenos Aires Provincial Police; 246 detainees in Buenos Aires Provincial Penitentiary Service; 1,886 detainees in Buenos Aires City Police, and 1,731 detainees in other Provincial Penitentiary Services.” "In other words, the number of available places is insufficient to meet the demand for admission of detainees to the federal prison system," the ministry said. “In particular, it should be noted that the SPF still holds 5,564 persons deprived of liberty in its custody in cases that are being processed before the ordinary criminal justice system in CABA.” “It is long-standing doctrine of the Supreme Court of Justice of the Nation that the National Constitution, since the 1994 reform, recognizes the autonomy of the City of Buenos Aires and that, in this sense, the national character of the ordinary courts of CABA is merely transitory (Rulings: 338:1517; 339:1342; 340:103; 341:611, among others),” it argued and stated: “Consequently, the fact that the transfer of ordinary justice in criminal matters to the scope of the Autonomous City of Buenos Aires has not yet been completed affects the physical capacity of the SPF to accommodate people currently available, while also preventing the accommodation of people deprived of their liberty by order of different courts with federal jurisdiction who, consequently, must remain housed in facilities outside the SPF.” "The National Government understands that the construction of new penitentiary infrastructure is a fundamental public policy to overcome the prison emergency," the ministry stated. There, the construction of the complex in Marcos Paz was mentioned: "In order to locate the penitentiary establishments outside the urban areas and promote the increase of penitentiary places in an establishment in accordance with current penitentiary policies, the collaboration agreement was signed between the Ministry of Justice and Human Rights of the Nation, the GCBA and the State Property Administration Agency (AABE) registered as CONVE-2018-10825744-APN-DDMIP # MJ, by which the relocation of the Federal Penitentiary Complex of CABA (Devoto Complex) and its transfer to a new Federal Penitentiary Complex, located in the Marcos Paz district, Province of Buenos Aires, with capacity for 2,240 accommodation places was promoted. "That the construction of the new Marcos Paz Federal Penitentiary Complex was unilaterally suspended by the GCBA, breaching the commitments assumed in the aforementioned agreement. That the completion of said work would have allowed the relocation of the penitentiary services of the Federal Penitentiary Complex of CABA (Devoto Complex), expanding the accommodation capacity of the SPF."
