Work Detail The petitions filed by Shri TechTex Private Limited and Shakti Polyweave Pvt. Limited focus on issues related to the recovery of expenses incurred in providing electricity supply and other miscellaneous charges. The two companies, engaged in the manufacturing of plastic yarn, cloth, and related products, are challenging the charges levied by the Gujarat Energy Transmission Corporation Limited (GETCO) and the Uttar Gujarat Vij Company Limited (UGVCL). The companies argue that the charges, specifically the proportionate line charges and cost contribution charges, are arbitrary and illegal. They claim these charges are not following the Electricity Act, 2003, and the relevant regulations. The petitioners have units in the Dholka area and have applied for additional contract demand from UGVCL. For this additional demand, they were served estimates that included significant charges for capital assets, line charges, service connection charges, and security deposits. The petitioners highlight that these charges were collected based on administrative approvals from GETCO. However, they contend that these approvals were not in line with the regulations and lacked proper authorization from competent authorities like the GETCO board, the Gujarat Electricity Regulatory Commission (GERC), or the Gujarat Urja Vikas Nigam Limited (GUVNL). As such, they believe the collection of these charges is unjust and discriminatory. When the petitioners approached the Consumer Grievances Redressal Forum (CGRF), the forum observed that the recovery of pro-rata charges as per the administrative approvals was contradictory to GETCO’s circulars and lacked approval from the GETCO Board. The CGRF noted that the administrative approval used to justify the charges was not provided to GERC and was not circulated through GUVNL, indicating procedural lapses. Despite the CGRF’s observations, the respondents have not taken steps to obtain the necessary post facto approval from GERC or to refund the collected charges. This inaction prompted the petitioners to file these petitions, seeking relief from the GERC. They request the commission to declare the charges arbitrary and illegal, cancel the administrative approvals that allowed the collection of these charges, and direct the respondents to refund the charges with interest. The petitioners argue that the regulations only allow the recovery of reasonable expenses incurred specifically for supplying a particular consumer. They emphasize that charges cannot be recovered for existing lines or infrastructure not specifically erected for the consumer. They seek clarification from the GERC on this matter, as they believe the current charges imposed by GETCO and UGVCL do not comply with the regulations and are unjustly burdensome. The petitions by Shri TechTex Private Limited and Shakti Polyweave Pvt. Limited raises significant concerns about the legality and fairness of the charges imposed by the electricity transmission and distribution companies in Gujarat. They seek the intervention of the Gujarat Electricity Regulatory Commission to address these issues and ensure that the charges are aligned with the regulatory framework and principles of natural justice.
