On August 12, 2020, Can Giuoc Regional General Hospital announced the results of contractor selection for the 2020 Industrial Hygiene Supply Package. Accordingly, the bidding package priced at VND3,170,572,000 belonged to An Loc Investment Trading Services Company Limited with the winning price of 3,120,385,000 VND.
Right after that, Tam Sinh Phu Co., Ltd. issued a petition on the result of contractor selection as well as denouncing the contractors bid (Bids) was not confidential.
The package has the participation of two contractors An Loc and Tam Sinh Phu. According to the bid opening record, the bid price of An Loc is 3,120,385,000 VND. Bid price of Tam Sinh Phu is 2,920,671,600 VND. According to the evaluation report, Tam Sinh Phu failed in terms of technical and experience capacity.
The content of Tam Sinh Phus recommendations said that the bidding documents (Bidding Documents) of the above package were issued from 10:42 am on July 8, 2020 to 9:30 on July 22, 2020. “Right after the bid opening time, on 23/7/2020, the information and content of our companys Bids were provided to another contractor participating in this package. The company has proof of verification and is willing to provide evidence at the request of competent persons, investors, inspection and examination agencies, state management agencies on bidding activities ”, Contractor positive.
More specifically, the representative of the contractor said that Tam Sinh Phu is a unit specialized in providing industrial cleaning services for hospitals, with many partners and customers in many other localities. This contractor unexpectedly received information from a customer: "There is a contractor contact to verify the contract of Tam Sinh Phu is underway". It is worth mentioning, the above "verified" contract is the document in the Bid submitted by Tam Sinh Phu and is in the time of bidding for the bidding package at Can Giuoc Regional General Hospital.
It is worth mentioning that, although Tam Sinh Phus petition sent to the Procuring Entity from August 2020, the response was unsatisfactory. “The Procuring Entitys reply is irresponsible, does not focus on and only confirms that the contractor selection is in accordance with regulations. This requires the Contractor to continuously submit a subsequent petition, send it to the Department of Planning and Investment of Long An Province ”, said Contractor Tam Sinh Phu.
Up to now, Tam Sinh Phu has submitted a 4th petition to clarify the non-confidentiality of bid information of this contractor in the bidding process.
Pause the bid
In a reply dated August 24, 2020, Can Giuoc Regional General Hospital said, Tam Sinh Phu contractor did not achieve some items such as: key personnel; There are not enough aseptic procedures for each different department depending on the sterility of each area according to the regulations of the Ministry of Health and does not provide a permit for circulation of disinfectants.
On October 2, 2020, Long An Department of Planning and Investment sent a document to Can Giuoc Regional General Hospital to request the Hospital to suspend the bid until the competent authority had a written response to the contractors petition. At the same time, the Department of Planning and Investment of Long An requires the Procuring Entity to report on the contractor selection process (together with the evaluation report and relevant documents clarifying the Bid). Specifically, the Department of Planning and Investment of Long An requires to report on the clarification of the bid of Tam Sinh Phu Co., Ltd., the bid solicitor has complied with the provisions of Clause 3, Article 16 of Decree 63/2014 / ND-CP on the detail the implementation of some articles of the Bidding Law? In particular, the Department of Planning and Investment of Long An requested Can Giuoc Regional General Hospital to provide honest and objective information and report to the Department of Planning and Investment.
