The package is invested by the Peoples Committee of Trieu Loc commune, directly inviting the bid. There are 3 contractors submitting the Bids, Duc Xuan Construction Company Limited is the winning bidder with the price of 1.925 billion VND (the Investor has issued a decision approving the contractor selection result on January 7, 2020).
The reason for bid cancellation is that the bidding package has not been allocated capital and there are errors in the contractor selection process as prescribed in Article 123 of Decree 63/2014 / ND-CP.
Previously, on August 10, 2020, the Department of Planning and Investment of Thanh Hoa province issued Inspection Conclusion No. 4635 / KL-SKHDT, which stated: Investor (Peoples Committee of Trieu Loc commune) organized contractor selection. the aforementioned construction contract package, the contract has not signed the capital plan, signed the contract but has not implemented the construction yet, has not completely resolved the recommendations in the contractor selection. Request the Investor to issue a document that does not recognize the result of contractor selection and handle the responsibilities of related collectives and individuals.
On October 14, 2020, discussing with the reporter of the Bidding newspaper, Mr. Le Ngoc Doan, Chairman of the Peoples Committee of Trieu Loc commune, said that the investment in the traffic road of Trieu Loc commune was unanimously included in the approval resolution. to approve the 2020 public investment plan of this commune. However, when the contractor selection is completed and is about to sign the construction contract, Ngoc Khanh Company Limited (1 out of 3 contractors that submitted Bids but is rejected) has repeatedly proposed, the content of petition verification each time, there are differences in personnel so the project has not been constructed and the commune has not disbursed the capital.
Although Ngoc Khanh Co., Ltd. has proposed many times, the consultant of bid evaluation still affirms the point of view of this type of contractor because the declaration of the capacity and experience of the site leader is not honest. In the process of verifying the capacity and experience of the staff of Ngoc Khanh Company Limited, the Peoples Committee of Thach Tuong commune, Thach Thanh district issued a confirmation document 3 times with inconsistent content (from November 2019 to March) 2020) should directly affect the result of resolving the contractors petition, which is the cause of interrupting the contract signing process with the winning contractor and delay in construction execution.
In addition, over the past time, due to the influence of the Covid-19 epidemic and the merger process of Chau Loc commune into Trieu Loc commune, the leader of the Peoples Committee of Trieu Loc Commune has decided to stop signing the contract and carry out the construction of the project to waiting for the inspection conclusion of the Department of Planning and Investment of Thanh Hoa province.
The representative of the Peoples Committee of Trieu Loc commune also said that, after obtaining the conclusion of the functional agencies of Thanh Hoa province, the commune had carried out the procedures to cancel the bid and prepared to re-bid this package. Learning from the experience after the first bidding and in order to avoid mistakes in the contractor selection process, the Peoples Committee of Trieu Loc commune has replaced another consultant to assist the Investor in organizing the bidding. The leader of the Peoples Committee of Trieu Loc commune admitted the Investors shortcomings in the lack of determination with the excluded contractor, leading to the process of selecting the contractor to be delayed and slow to construct the project.
Currently, the Investor and the consultant are coordinating to review the criteria and norms in the Bidding Documents in the Bidding Package No. 02 and re-invite the bid as soon as possible (expected to be November 2020). |
