According to BMTs assessment, this standard has been canceled, stipulated in Decision No. 212 / QD-BXD of February 25, 2013 of the Ministry of Construction on canceling construction industry standards (phase 1). Therefore, NT applied this standard is wrong, unsatisfactory. This content belongs to the methodology part of Bidding Documents and Contractor, it is not allowed to calculate the methodological part of the methodology (ie "0" points).

After receiving the petition of the NT, the Department of Culture, Sports and Tourism of Thai Nguyen province responded, the representative of BMT worked with the bidding consultant (Architecture and Technology Transfer Company Limited). building HMP); consulting unit evaluating the result of NT selection (Thai Nguyen Consulting and Construction Investment Co., Ltd). Both consulting units affirmed that the results of the work performed under the consulting contract with the Investor are correct in the bidding law, the approved bidding documents. BMT agrees with these ideas.
Commenting on the proposed situation mentioned above, a bidding expert said that if evaluating Bids according to the method of "case in file", it is clear that BMT is not wrong with the provisions of bidding law. Because NT petition has proposed the application of invalid technical standards. However, BMT may ask the petitioner to clarify the Bid, because this is not a serious error.
In fact, the analyst, there are some NT due to negligence in the preparation of Bids, may not have updated the newly issued documents, so new situations to occur as above. Even at the time of signing the contract, if the law has changed compared to the time of bidding proposal, then NT must also comply with the new regulations. |
