The above bidding package has the bid price of VND 2,271 billion. Phong Le Co., Ltd won the bid at VND 2.25 billion, down VND 21 million, equivalent to less than 1% savings.
Bidding packages are organized online bidding. There are 2 contractors submitting bids (E-HSDT). The bid price of Phong Le is the same as the winning price. And the bid price of the other contractor - Vietnam CAD / CAM Technology Co., Ltd (referred to as CAD / CAM) is 1,871 billion dong.
CAD / CAM was rejected because it did not meet the requirements for capacity and experience. Specifically, according to the E-HSDT evaluation report, the Contractor did not meet the requirements of key personnel. The contractor declares in E-HSDT according to forms No. 11a, 11b, 11c on the National bidding network system and the labor contracts of key personnel are: "Mr.: Ta Quang Ky". However, the information in the professional qualification attached by the Contractor is a document proving the name: "Mr.: Ta Quang Ky".
In the past 3 years, CAD / CAM has been announced to win 14 bidding packages, mainly by a number of Industry Universities in some provinces and a number of defense units.
Around the same time, Phong Le was announced to win 19 packages, many in Quang Ninh and invested by Vinacomin units. In particular, only in the last 1 month, Phong Le has won 3 packages in a row at Ha Tu Coal Joint Stock Company - Vinacomin, including 2 packages of contractor appointment.
Talking to a reporter of the Bidding Newspaper, an official of Ha Tu Coal Company - Vinacomin said that in the process of comparing documents provided by the Contractor, scanning the System, the Company proposed the Contractor. provide additional documents, clarifying the inconsistency of the above mentioned personnel names. As of October 31, 2019, the Company received documents clarifying E-HSDT. In particular, the contractor asserted the name of the employee is "Ta Quang Ky" but due to errors in the printing process of the Hanoi University of Science and Technology, the position of the "" "mark was skewed to the letter" K ", so it followed senses the word "Ky" will look into the word "Ky".
The above officer said that the explanation of the Contractor is only the commitment of the unit, there is no suitable legal basis for the Bidding Expert Team to consider and evaluate. Therefore, the Expert Group agrees that there is no basis to evaluate this content according to the current regulations.
Not responding to this type of exclusion, CAD / CAM proposed canceling the contractor selection result.
A bidding expert said that according to the provisions of Clause 5, Article 15 of the Ministry of Planning and Investments Circular No. 04/2017 / TT-BKHDT of November 15, 2017, detailing house selection. Bidding through the national bidding network system: With regard to the content of capacity and experience, E-bid evaluation is done on the basis of information of contractors declared in E-HSDT without requiring contractors. Bidders must attach documents to prove it. In case of detecting that the contractor declares dishonestly, the contractor will be deemed to have committed fraudulent acts prescribed in Clause 4, Article 89 of the Bidding Law and will be banned from participating in bidding activities for 3 to 5 years according to Provisions in Decree No. 63/2014 / ND-CP. In the case of the aforementioned bidding package, this expert said that, in the evaluation of capability and experience, the bid solicitor should not remove the contractor immediately but continue to consider the evaluation based on the information declared in E. -HSDT, if the contractor is ranked first, the contract negotiation will require the contractor to provide supporting documents. |
