True, the BiH Audit Office in the audit report claims that the Agency did not find any irregularities in the implementation of the Public Procurement Law of BiH. However, the auditors nevertheless had objections (they call them observations) that refer to the required evidence of the tenderers ability. The tenderer is a company that is a public tender for goods, services or works. - In our opinion, it is justified to ask for additional evidence for certain procedures, so we cite examples: in two cases, competitive requirements did not require qualification requirements for proving the personal capability of the bidders, so we consider it justified to seek proof of payment of indirect and direct taxes because framework agreements have been concluded with bidders for a period of three years (procurement of fixed telephony services and maintenance of hardware equipment), - said the Audit Office. In the second pimera, conditions for proving personal abilities were set, but without setting other conditions (performing professional activities and technical and professional capability). - According to the presented information, the conditions for proving other qualifications of the bidders have not been set because they are known from the previous period, when the bidder implemented the software whose maintenance is the subject of procurement - the BiH auditors conclude. However, lets go back to the example that the BiH Public Procurement Agency did not ask the bidders for proof of payment of indirect and direct taxes. If we look at the practice in other institutions, we will see that due to this important detail even the procedures of public procurement are canceled. For example, in early August 2018, the BiH Presidency annulled the public procurement procedure for the selection of the most favorable bidder for the maintenance of the damage vehicle in the warranty period, in Banja Luka. As stated in the explanation, one of the reasons for the cancellation was that the best bidder, Autokomerc Banja Luka, submitted the certificate of the ITA BiH, which states that there are outstanding, but outstanding obligations based on indirect taxes, other revenues and taxes. The logical question arises: if this was one of the reasons for the BiH Presidency to give up the most favorable bidder, why did not the auditors state that the Public Procurement Agency committed a serious offense when it did not even ask the bidder to prove whether the state paid taxes ?! The time before the Public Procurement Agency must be a crystal clear example to all other institutions in BiH. |
