Suspicious procurement in the Kosice region. According to the Independent Citizens Initiative of Košice and Košice Region, several questions have arisen regarding the handling of public resources when signing contracts. Initial Finder material is available in the Truth Diary.
According to these findings, the robe of Rastislav Trnka and his team had to conclude a number of strange contracts that were not published on the Offices website. This should also include a contract with Ultima ratio of Liptovský Mikuláš concerning public procurement through this company for EUR 58,320. The county has its own departments for public procurement. Another is an agreement with KPMG on advice related to the new Personal Data Protection Act and the GDPR Regulation. For this advice and analysis, the county has to pay more than 56,000 euros.
Last ratio has fallen victim to suspicion. "This is a framework agreement that provides for the speedy implementation of several dozens of public procurement for projects funded by the European Structural Funds. Such a number of contracts beyond the normal operational needs of the county can not be implemented by internal capacities. That is why the region selected a consultancy provider for the tender and succeeded our company, "explains Milan Cupra.
KPMG Marketing Manager in Slovakia Beata Dubenová stressed that advice on GDPR and information technology is their common service to private and public organizations. "The contracts with the Kosice County were concluded on the basis of the results of the tender, which was standard and transparent from our point of view," Dubenová said.
The Citizens Initiative also does not like the County to disclose public procurement information from the winners of these contracts. "After studying the content, we began to wonder what the public procurement conditions were for these contracts. We have learned that the Trnka bathrobe has changed this directive in such a way that low-value public procurement, which according to law represents orders for goods and services up to 50,000 euros excluding VAT and construction work up to 150,000 euros excluding VAT, does not publish on the website Office. This change resulted in public procurement being hidden from public scrutiny, "he said in a document.
Therefore, they asked the county for access to public procurement documents. They received the answer that they can not make them available without the consent of the persons concerned because they contain the personal data of individual applicants. "Such a reason not only discloses the Freedom of Information Act, but it is so absurd that the procedure in question raises questions about whether any competition on these contracts has ever been implemented, and if so, whether or not the so-called" cover offers, "underlines the initiative. He adds that he wants to use all available legal steps to get information. In addition, the opinion of the Kosice County District Authority stated that sending information to a citizens initiative would put itself at risk of an action for interference with the rights of successful bidders.
The county claims it has not violated any law, nor has it done anything unobtransparent. According to him, Ultima ratio has been contracted to over-limit and under-threshold contracts, with the exception of commonly available goods and services where there is a greater degree of responsibility. "Many of these public procurement contracts are funded by European funds, where the sanctions are found to be in the form of a refund," said Mrs. Anna Cincarova, spokeswoman for the country. He did not comment on the contract with KPMG.
The President of the Association of Municipal Economists of Slovakia Eva Balážová states that one thing in publishing public procurement for low-value contracts is legal duty and the other is voluntary transparency. "If once a county or other public administration paves the way that it wants to be transparent and stands for it, I do not see an obstacle for why such contracts should not be published," comments Balážová, according to which it is neither difficult nor complicated from the point of view of administrative difficulty labor-intensive.
