The eviction of Kendal farmers due to the Batang-Semarang Toll Road project was rushed to complete Jokowis development target.
Two weeks ago, precisely on Friday (13/4), member of Indonesian Farmers Union (SPI) Kendal received a letter from the local District Court, regarding the execution of land clearing for the construction of the Batang-Semarang toll road there. If refusing to vacate the land, officers will do so by force on 23-26 April 2018.
Chairman of the Department of Strengthening, Supervision, and Consolidation of National Organization SPI Ali Fahmi explains, evictions carried out by BPN Kendal is unilateral action. Though the process of measuring and assessing the plots of land and buildings to be constructed toll roads has not been completed and not according to the will of the people.
He also mentioned the existence of maladministration by BPN Kendal. Because until now people are still mediating with other parties such as Ombudsman and Komnas HAM. Moreover, residents are also not involved discuss the price of compensation.
This hasty effort is done to pursue the target of Joko Widodo-Jusuf Kalla government to build infrastructure facilities.
As a result of that development, people who generally work as farmers, a total of 140 families who came from nine villages were forced to lose ground. The nine villages are Ngawensari Village, Galih Village, Sumbersari Village, Rejosari Village, Tunggulsari Village, Kertomulyo Village, Penjalin Village, Magelung Village, and Nolokerto Village.
Although residents have objected, the court still insists on executing.
The seizure of this land according to the General Chairman of Indonesian Farmers Union (SPI) Hendry Saragih is the impact of the implementation of Law No. 2 of 2012 on Land Procurement for Development for Public Interest (Land Acquisition Law). Henry considered the Land Acquisition Law to legalize land grabbing, although it was mentioned for development and public interest.
"This law forces people to agree on the price offered by the owners of capital. The position of the people of the landowners was weakened in the matter of compensation. There is no rule in the Act that regulates the issue of price compensation through consensus deliberation. Indemnification will use government interpretation and price benchmarks that can not be compromised. If there is a dispute, it will be directly brought to court, said Henry in Jakarta, Wednesday (25/4).
Departing from there the SPI strongly condemns the land grabs, which is done without regard Komnasham recommendations, ORI even from the Office of President Staff (KSP).
"This shows the arrogance of toll road project implementers, regardless of peasants rights and beyond humanity, we will take legal action and urge the government to crack down on the rights violations of peasants they are doing," he said.
One of the Suroso victims said that initially the community was happy with the construction of the toll road, but now the community is disappointed. This is because the number and size of the land measured by BPN does not match the value of their losses.
Until now residents are still restless and ask to improve the size and amount of land leveled. Moreover, there is no identification of compensation regarding the business and crops of citizens.
"If the size error in my opinion is only 10 meters, if up to 322 m2 it is too much," he said
Responding to it, the Secretary of Land Acquisition (P2T) from the National Land Agency (BPN) Kendal Nanang Suwasono said it had already delivered the stages in land procurement to the Kendal community. Starting from the identification, inventory, and collection of objections if there is a discrepancy of data that has been set for three days.
However, until the deadline has been determined, no complaints or objections from the citizens. When the announcement of citizens also do not want to see and do not file objections at the grace period has been given. Not only that, his side has also tried to conduct deliberation, but many citizens who just can not attend.
"If more than that, we do not serve," he told Alinea by telephone on Thursday (26/4).
He did not deny, before the residents did not provide data first. They want preconceived pricing. In fact, according to the Law on land procurement prices will be given by appraisal, if the data has been completed.
