GENERAL: · Operation and function of vehicles and Drivers shall be governed by Motor Vehicles Act/Motor Vehicles Rules and AP Motor Vehicles Rules and these shall be the responsibility of the contractor. · The contractor shall work as per instructions <(>&<)> priorities given by respective Nodal officer. 2. VALIDITY OF CONTRACT: · Company also reserves the right to terminate the contract after giving 15 days’ notice without any reason specified. · As soon as the contractor fails to comply the legal/statutory liabilities without proper justification with the principal company, the company can terminate the contract immediately on that ground without any notice. 3. SCOPE OF WORK: · The deployment of vehicles shall be subjected to inspection by Essar Steel India Limited, Vizag and it should be strictly in accordance with applicable norms and standards formulated by RTO. · It will be ensured that the vehicle is well maintained at all times and fully road worthy. In case of non-functional state of Horn, Lights, indicators and vipers will not be accepted. · Contractor must ensure that driver is punctual, polite, well behaved, well dressed, disciplined and should ensure he carries a Mobile phone all the time. · Contractor shall ensure the maintenance of the vehicle in close co-ordination with Essar's designated official before taking the vehicle for maintenance. · Breakdown, if any, will be attended by contractor. In case your vehicle fails to report in time for any reasons whatsoever, we shall make alternative arrangements and the cost of the same will be debited to contractor. · In case the contractor fails to provide vehicle in time, Vehicle is detailed without fuel or any other short coming which are not up to the satisfaction of the admin I/c, then ESTL reserves the right to engage another vehicle and the charges for the same together with reduction of their monthly bills of transporter on pro rata basis (monthly payment/ 15 working days) shall be made. · In addition to the above, the contractor will also be responsible for overall supervision of day to day movement of vehicle. He shall work in close coordination with the admin department for taking necessary instruction. 4. LOG BOOK: · Trip wise entry every day should be maintained. · On completion of each trip driver has to take signature of the ESTIL- . · Complaint/Suggestion book to be kept in all the vehicles with driver. 7. OTHER REQUIREMENTS: · Drivers must wear uniform. · Driver should have minimum driving experience of 3 years and should have medically fit for the job. · All Safety compliances with respect to MVI act should be followed. · Drivers should not chewing tobacco / gutka etc. While in duty hours. · Drunk and drive is strictly prohibited. · Drivers should not use mobile phones while driving. · Driver’s insurance should be in the scope of vehicle owner / contractor. · If any damages occurred during the period the contract, expenses of the damages of the vehicle will be borned by you. The above Hired Vehicles is mainly for Essar-Associates of our Company and Government Officials (In Related with Project / Plant). However, if the Vehicles need to go out for maintenance or any reasons the same needs to be brought to the notice of ESTIL- admin department before leaving the site / office. Under no circumstances, contractor shall be allowed to use the vehicles for his own personal use or any other business purpose during the period of contract even during off time or holidays (when the vehicles are not used by Essar). Any violation in this regard will result in termination of the contract. The Contractor's Driver should not be allow taking any passenger while vehicle is on Essar / office duty. 8. OTHER CONDITIONS: · Contractor should ensure that all drivers are aware of our driving safety policy VIZ-PP-SAF-DPM-08.3. · Vehicles shall be and maintained in safe working in line with manufacturers’ specifications and legal requirements with respect to MVI act 1988. · Drivers should carry out daily and weekly vehicle checks to ensure the condition of the vehicle. · Drivers must not use a mobile phone while operating the vehicle (this includes use of hands free device). In case of violation of any such statutory provisions under Labour Laws or any other law applicable by the Contractor, there will not be any liability on the company. · The contractor shall indemnify the company against all other damages/charges for which the company may be held liable or pay on ac count of the negligence of the contractor or his staff or any person under his control whether in respect of accident/injury to the person or damages to the property of any member of the public or any person or in executing the work or otherwise and against all claims and demand thereof. The company shall not be responsible financially or otherwise for any injury to the driver or person deployed by the contractor during the course of performing the duties. · The contractor shall provide vehicles as per requirement of the Department including public holidays, Saturdays and Sundays. · The vehicle and Driver shall remain available all the time as per Duty Roster and shall not leave place of duty without prior permission. · Complaint/Suggestion book to be kept in all the vehicles with driver. · Spare Wheel and necessary tool kit. · Vehicle fitness certificate should be present in the vehicle. · Driver shall hold first aid training certificate. · Vehicle should have packaged drinking water( 500ml) min 8 No’s. BILLING <(>&<)> PAYMENT TERMS: · The CONTRACTOR shall raise monthly running account bill and the due payment shall be paid within 15 days from the date of receipt of bill of duly certified bills by Admin In charge, after deduction of applicable taxes/ duties/ levies as per Govt.Norms. · Notwithstanding the release / payment of bills by the ESTIL to the contractor, the contractor shall ensure that the payment of wages and other statutory within time limit. There shall not be linkage between release / payment of the bill by the ESTIL to the contractor and the payment of wages / other dues by the contractor to his worker.
