1 .2. A Detailed Description Of The Subject Of The Contract Is Included In Annex 2 To Swz Software Delivery With Implementation Services, Training And Support3. The Contractor Is Obliged To Submit Together With The Offer Of The Description Of The Offered Software Enabling The Employer To Verify The Compliance By The Software Of The Minimum Requirements, Indicating For Each Element Contained In Annex 2 To Swz (Detailed Description Of The Subject Of The Contract) In The Material And Quantitative Statement Of The Manufacturers Name And Software Name; The Description Should Be Prepared On The Basis Of Annex 2 To Swz (Detailed Description Of The Subject Of The Contract) Using The Tables Contained In It And Must Refer To Each Of The Requirements Set Out In This Attachment. In The Event That The Contractor In Any Of The Item Offers Parameters That Do Not Meet The Requirements Specified By The Employer, The Offer Will Be Rejected Pursuant To Art. 226 Para. 1 Point 5 Of The Public Procurement Law). 4. The Trademarks, Patents Or Origin Indicated In The Description Of The Subject Of The Contract Are An Auxiliary For Determining The Parameters Of The Subject Of The Contract. The Employer Allows The Possibility Of Using Equivalent Solutions With Technical And Utility Parameters Not Worse Than Those Given In The Description Of The Subject Of The Contract. The Contractor Who Refers To The Equivalent Solutions Described By The Contracting Authority Is Obliged To Show That The Delivery He Offers Meets The Requirements Set By The Contracting Authority. It Is Allowed To Offer Equipment With Higher Parameters. The Contractors Obligation To Demonstrate The Equivalence Of The Product Is An Obligation Arising From The Act, Which Can Be Fulfilled In Any Way Allowing The Employer To Clearly State The Compatibility Of The Systems, Technology, Materials/Products Or Devices Offered In The Offer With The Requirements Specified In The Project Documentation And Specifications, Which Should Be Demonstrated At The Stage Submitting Offers Containing Equivalent Products. In The Case Of Failure To Make Documents That Make The Use Of Technologies, Systems, Devices And/ Or Equivalent Materials/ Products, The Contracting Authority Will Consider That The Contractor Has Presented In The Offer Systems, Technologies, Devices And Materials/ Products Described In The Description Of The Subject Of The Contract. 5. The Contractor Is Obliged To Complete The Order On The Principles And Conditions Described In The Provisions Of The Contract Constituting Annex 3 To Swz.
