Data-Transmission Equipment – ​​Purchase Of Electronic Devices And Services For Media Reading And Monitoring, Including The Implementation Of E-Services. 1. The Subject Of The Order Includes The Purchase Of Electronic Devices And Services For Reading And Monitoring Media In The City Of Kętrzyn And Selected Locations Of The Kętrzyn Commune, Along With The Implementation Of E-Services As Part Of A Project Co-Financed By The Regional Program For 2021-2027 European Funds For Warmia And Mazury Entitled . Public E-Services For Residents Of The City Of Kętrzyn Includes In Particular: 1) Conducting A Pre-Implementation Analysis; 2) Development And Implementation Of A System Including: A) Providing The Necessary Software With Documentation; B) Implementation Of The Ebok System; C) Carrying Out Tests; D) Implementation Of E-Services; E) Delivery And Implementation Of A Telemetry Supervision System; F) Delivery And Installation Of Telemetry Devices In Places Indicated By The Ordering Party (In The City Of Kętrzyn And Selected Locations Of The Kętrzyn Commune); G) Integration Of The Ordered System With Systems Operating At The Ordering Party. 3) Supply Of Computer Equipment; 4) Providing Consultation And Training For Administrators, 5) Providing Technical Assistance Services As Part Of The Guarantee Of Quality Of Contract Execution. 2. A Detailed Description Of The Subject Of The Order Is Included In Annex No. 1 To The Swz - Description Of The Subject Of The Order And In Annex No. 10 - Draft Provisions Of The Contract. 3. The Ordering Party Requires That The Contractor Who Refers To Solutions Equivalent To Those Described By The Ordering Party Must Demonstrate (In Particular By Means Of Evidence Referred To In Articles 104-107 Of The Public Procurement Law) That The Supplies/Services Offered By Him Meet Requirements Specified By The Ordering Party. Documents Submitted By The Contractor To Demonstrate The Equivalence Of The Offered Subject Matter Of The Contract Must Be Submitted With The Offer And Will Not Be Subject To Supplementation. In Such A Case, The Contractor Attaches To The Offer A List Of Equivalent Solutions Together With Its Description Or Standards. 4. The Ordering Party Pursuant To Art. 95 Of The Public Procurement Law Requires The Contractor Or Subcontractor To Employ Persons Under An Employment Contract For The Execution Of The Order, If The Performance Of These Activities Involves Performing Work In The Manner Specified In Art. 22 §1 Of The Act Of June 26, 1974 - Labor Code, I.E. It System Implementation Activities, Except For Cases Where The Conditions Of Art. 22 §1 Of The Labor Code And The Performance Of The Work Will Not Be Based On An Employment Relationship, But Will Be Performed On The Basis Of The So-Called Self-Employment, Taking Into Account Direct Management, Then The Contractor Is Obliged To Inform The Ordering Party About This Fact And Indicate The Subcontracting. The Method Of Documenting The Employment Of The Persons Referred To Above And The Ordering Partys Rights To Control The Contractors Compliance With The Requirements Referred To Above And The Sanctions For Failure To Meet These Requirements Are Included In The Draft Provisions Of Contract No. 10 To The Swz. 5. The Ordering Party Requires That The Supply In Question Includes Products, Including Software
