The Subject Of The Order Is The Purchase And Delivery Of An Occupational Health And Safety Laboratory For The Needs Of The Emerging Industry Skills Center In The Field Of Energy In Nisko As Part Of The Project: Establishment And Operation Of The Industry Skills Center In Niž County In The Field Of Energy, Financed Under The National Reconstruction And Resilience Plan ( Kpo). A Detailed Description Of The Subject Of The Contract Is Provided In Annex No. 8. Description Of The Subject Of The Contract 2. The Ordering Party Provides For The Possibility Of Invalidating The Contract Award Procedure Pursuant To Art. 257 Of The Public Procurement Act, If The Public Funds That The Ordering Party Intended To Use To Finance All Or Part Of The Order Are Not Granted To It. 3. The Ordering Party Does Not Divide The Order Into Parts Due To The Fact That Such A Division Would Pose The Risk Of Excessive Technical Difficulties And Excessive Costs Of Performing The Order. Therefore, The Failure To Divide The Contract Was Dictated By Technical And Organizational Reasons And The Nature Of The Subject Of The Contract. 4. The Contractor Is Obliged To Demonstrate That The Offered Supplies Meet The Requirements Of The Ordering Party. 5. All Products From Specific Manufacturers Specify The Minimum Quality Parameters And Functional Features That The Products Must Meet In Order To Meet The Requirements Set By The Ordering Party And Constitute Only A Quality Standard Of The Subject Of The Order. 6. By The Provision Regarding The Minimum Requirements For Quality Parameters, The Ordering Party Understands The Requirements Of The Goods Contained In Publicly Available Sources, Catalogs And Manufacturers Websites. The Use Of Exemplary Manufacturers Names Is Only Intended To Clarify The Level Of Expectations Of The Ordering Party In Relation To A Specific Solution. Therefore, The Use Of Manufacturer Or Product Names Is For Example Purposes Only. When Describing The Subject Of The Order, The Ordering Party, Indicating The Designation Of A Specific Manufacturer (Supplier) Or A Specific Product, Also Allows Equivalent Products With Quality Parameters And Functional Features, At Least At The Level Of The Parameters Of The Indicated Product, Thus Accepting Every Product With The Indicated Parameters Or Better. In Such A Situation, The Ordering Party Requires The Submission Of Appropriate Documents Authenticating These Materials Or Devices. 7. For The Specified Devices, The Given Parameters Are Minimum Values, Any Equipment With Parameters Better Or Higher Than Those Specified Meets The Requirements Specified By The Ordering Party. All Devices Should Meet All Regulations Regarding The Right To Be Approved For Use In Poland And Have Appropriate Documents Proving Compliance With All Necessary Standards And Guidelines That The Above-Mentioned Equipment Should Meet Before It Is Approved For Use. 8. Whenever This Tor (In The Description Of The Subject Of The Order) Mentions Materials, Devices, Computer Programs, Etc., Specifying Trademarks, Patents Or Origin, Source Or Specific Process
