The Ordering Party Requires That The Delivered Subject Matter Of The Order Be Brand New, Free From Traces Of Use And Not Subject To Third Party Rights, Of Good Quality And Approved For Trading. Moreover, No Piece Of Equipment Or The Requested Part May Be Reconditioned, Post-Exhibition Or Previously Used By Another Entity. The Equipment Will Have The Required Approvals And Certificates. 4. The Contractor Is Obliged To Provide A Warranty For The Offered Equipment In Accordance With The Provisions Of The Swz And Annexes. 5. Equivalence: The Ordering Party Informs That Wherever In The Description Of The Subject Of The Order There Are References To Proper Names, Trademarks, Patents, Origin, Source, A Specific Process That Characterizes The Products Delivered By A Specific Contractor, This Is Justified By The Specificity Of The Subject Of The Order And The Ordering Party Cannot Describe The Subject Of The Order Using Sufficiently Precise Terms, And Within The Above-Mentioned Indications, The Ordering Party Allows Equivalent Solutions. The Use Of Specific Names Is Only Intended To Clarify The Level Of Expectations Of The Ordering Party In Relation To A Specific Solution And Serves To Indicate The Minimum Parameters And Functional Features Required By The Ordering Party.
