The Subject Of The Order Is The Purchase And Delivery Of A R-2 Category Motorboat With A Boat Trailer Intended For Sppp In Częstochowa. The Boat Will Be Used To Patrol Water Areas, Conduct Rescue Operations, Take Drowning People On Board, And Ad Hoc Tow Other Small Vessels. The Boat Must Be Adapted For Transport By Road On Public Roads Using A Boat Trailer. Technical Details Of The Subject Of The Order Are Set Out In Annex No. 3 To The Swz - Description Of The Subject Of The Order. The Parameters Of The Subject Of The Order Described In Annex No. 3 To The Swz Constitute The Minimum Requirements Of The Ordering Party. Failure To Meet The Minimum Requirements Will Result In Rejection Of The Offer As Inconsistent With The Terms Of The Contract Pursuant To Art. 226 Section 1 Point 5 Of The Public Procurement Act. The Ordering Party Agrees To Change The Delivered Subject Of The Order To A Different One Than That Offered In The Tender Form In Cases Where The Contractor Demonstrates That The Offered Subject Of The Order Has Been Withdrawn From Sale Or Its Production Has Been Discontinued, There Is No Access To It On The Polish Market (Confirmed By The Manufacturer Or Sales Representative On The Polish Market) The Ordering Party Allows The Possibility Of Offering And Delivering Another Subject Of The Order, Provided That Its Technical Parameters Are Not Worse Than Those Of The Offered Product And The Price Is Not Higher Than That Offered In The Offer Form. In The Case Referred To Above, The Contractor Must Obtain The Ordering Partys Consent To Change The Offered Subject Of The Order. The Ordering Party Requires That The Offered Boat And Boat Trailer Be Brand New, Class I, Unused, Unregistered Trailer, Manufactured No Earlier Than 2023, Free From Manufacturing And Legal Defects, Approved For Trading, Meet The Quality And Performance Standards Required By Law, Met Polish And European Safety Requirements, And Had A Boat Class Certificate From Prs Or Another Entity Authorized To Control Quality And A Ce Certificate Of Compliance With Directive 2013/53/Eu Of The European Parliament And Of The Council Of 20 November 2013 On Recreational Craft Watercraft And Water Scooters (Journal Of Laws Ec L 354/90 Of December 28, 2013), Allowing For Operation At Least In Navigation Areas And Hydrometeorological Conditions In Poland And Met The Requirements Specified In Annex No. 3 To The Swz. All Elements Of The Boat And Its Equipment Subject To Compliance Must Be Marked With An Appropriate Mark, E.G. Ce. The Ordering Party Requires The Contractor To Indicate The Brand, Model, Version, Year Of Production, Symbol Or Other Additional Data Enabling Clear Identification Of The Offered Subject Of The Order In Annex No. 1 To The Swz (Offer Form). Failure To Enter Data In The Dotted Spaces In The Offer Form Will Result In Rejection Of The Offer Pursuant To Art. 226 Section 1 Point 5 Of The Public Procurement Law - As Inconsistent With The Terms Of The Contract If It Is Not Possibl
