Supply Of Oboe, Love Oboe, English Horn At A High Professional Level For The Needs Of Sofia Philharmonic. The Scope Of The Activities Subject To The Award Of This Contract Includes An Order For The Production Of The Musical Instruments Offered By The Contractor During His Participation In The Procedure For Awarding The Public Contract And Approved By The Contracting Authority, Providing An Opportunity For The Musicians/Experts/The Contracting Authority, For The Final Selection Of These Instruments At The Manufacturers Factory/Selection Regarding The Sound Qualities Of The Respective Offered Instrument, Delivery, Transport And Warranty Service Of The Musical Instruments And Accessories Specifically Selected By The Contractor, Tuning Of The Musical Instruments (If Applicable), After Their Delivery To The Contractors Site, Instruments And Warranty Service Of The Musical Instruments And Their Accessories (Hereinafter Referred To As The Assets) Within The Warranty Period For The Individual Instrument Offered By The Contractor; The Commission Examines, Evaluates And Ranks The Offers In Accordance With Art. 104, Para. 2 Of The Zop, In Which The Evaluation Of The Technical And Price Proposals Of The Participants Is Carried Out Before Conducting A Preliminary Selection. At The Opening Of The Present Public Procurement, No Financing Was Provided, And The Contract With The Selected Contractor Includes A Clause For Deferred Implementation. In This Sense And On The Basis Of Art. 114 Of The Zop Provides That: The Term Of The Contract Begins After Confirmation By The Contracting Authority Of Secured Financing And Presentation By The Contractor Of The Specified Performance Guarantee, Presented In Accordance With Art. 111, Para. 5 Of The Zop. In Case Of Non-Presentation Of The Performance Guarantee Within The Term Specified By The Contracting Authority, Without The Existence Of Objective Reasons, The Contracting Authority Terminates The Contract. When, After The Expiration Of A Three-Month Period From The Conclusion Of The Contract, Financing Is Not Provided, Either Party May Request Its Termination Without Notice. When, After The Expiration Of 10 Months From The Conclusion Of The Contract, Financing Is Not Provided, The Contract Is Considered Terminated. Terms Of Payment: 100% Advance Payment In The Amount Of The Total Value Of The Performance Contract, Payable After The Funds Provided In Advance Are Secured With A Guarantee Under Art. 111, Para. 5 Of The Zop, Which Is In The Amount Of These Funds And The Same Is Released Up To 3 /Three/ Working Days After The Return Or Utilization Of The Advance And After Presentation Of An Invoice - Original For Advance Payment, Drawn Up In Accordance With The Requirements Of The Accounting Act And The Act For Vat. Reasons Under Art. 231, Para. 5 Of The Zop. According To The Provision Of Art. 231, Para. 5 Of The Zop, The Contracting Authorities May Not Fully Or Partially Apply Standardized Requirements And Documents Under Para. 3, When This Arises From The Nature Of The Order, But They Are Obliged To Indicate Reasons In The Documentation When Opening It.
