The Subject Of The Order Is The Supply Of Hospital Beds To The Care And Treatment Center And The Spzoz Hospice In Siedlce, In Accordance With The Conditions Specified In The Swz. The Order Is Co-Financed From The Funds Of The Project: Cross-Border Health And Palliative Care Interreg Next Poland - Ukraine Program 2021-2027. The Ordering Party Requires The Offer Of Products Medical Devices Within The Meaning Of Regulation (Eu) 2017/745 Of The European Parliament And Of The Council Of 5 April 2017 On Medical Devices, Amending Directive 2001/83/Ec, Regulation (Ec) No 178/2002 And Regulation (Ec) No 1223/ 2009 And Repealing Council Directives 90/385/Eec And 93/42/Eec. If The Ordering Party Describes The Subject Matter Of The Contract By Reference To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Article 101(1). Point 2 And Section 3 Of The Act, The Ordering Party Allows Solutions Equivalent To Those Described. It Should Be Understood That Such An Indication Is Accompanied By The Words Or Equivalent. Contractors May Submit Offers Containing Solutions Equivalent To The Subject Of The Contract Presented In The Tor - In Accordance With Art. 101 Section 4, 5 And 6 Of The Public Procurement Act, However, They Are Obliged To Demonstrate That The Solutions They Offer Meet The Requirements Specified By The Ordering Party. Equivalence In Terms Of Technical, Functional And Operational Parameters Is Intended, In Particular, To Ensure That Parameters Are Not Worse Than Those Assumed In This Tor. Solutions, As Well As Elements And Materials, With The Same Functional And Qualitative Properties As Specified In The Description Of The Subject Of The Contract Are Considered Equivalent, But Marked With Another Trademark, Patent Or Origin. What Is Important Is That An Equivalent Product Is A Product That Is Not Identical To The Reference Product, But Has Certain Features And Parameters That Are Important For The Ordering Party And Are Similar To The Reference Product. Features And Parameters That Are Important For The Ordering Party Are Those That Will Allow Maintain The Parameters And Features Assumed By The Ordering Party For All Products And Allow Them To Obtain Parameters Not Worse Than Those Specified In Annex No. To The Swz. The Burden Of Proving Equivalence Rests With The Contractor. A Contractor Who Refers To Solutions Equivalent To Those Described By The Ordering Party Is Obliged To Demonstrate That The Offered Subject Of The Order Meets The Requirements Specified By The Ordering Party By Submitting A Description Of The Offered Products Along With Demonstrating The Features Of Equivalence In Relation To The Requirements Described By The Ordering Party.
