The Subject Of The Agreement Referred To In Sec. 1 Includes, In Particular, The Implementation Of The Following Works: 1) Removal Of A Layer Of Fertile Soil (Topsoil) 45 Cm Thick Under The Designed Devices: Approx. 38 Cm: Approx. 136.80 M³; 3) Mechanical Execution Of The Trough To A Depth Of 30 Cm In The Place Of The Planned Accesses To The Playground And In Places Provided For Benches: Approx. To The Playground And In Places Provided For Benches: About 25.01 M²; 6 Cm (Gray Or Brick-Red) On A Cement-Sand Bedding, Th. 5 Cm, In Places Provided For Benches: About 11.70 M²; 6 Cm (Brick Red) On A Cement-Sand Bedding, Th. 5 Cm, In The Place Of The Planned Access To The Playground: Approx. 13.31 M²; 7) Manual Spreading Of Fertile Soil (Topsoil) With Transfer On A Flat Area (Earth From The Excavation), In The Space Between The Existing Sidewalk And The Designed Fence Of The Playground: Approx. 50 .00 M³; 8) Manual Execution Of The Grass Surface With Sowing And Covering The Seeds With A Spike Roller: Approx. 200.00 M²; 9) Execution Of A Playground Fence Made Of System Welded Panels, 1.20 M High, Equipped With A Prefabricated Concrete Foundation: Approx. 72.00 M; 10) Construction Of A 100 Cm Wide Wicket In The Fence Of The Playground Made Of Welded System Panels, 1.20 M High, Equipped With A Prefabricated Concrete Foundation: 2 Pieces; 11) Delivery And Assembly Of Park Benches With Backrests: 3 Pieces; 12) Delivery And Assembly Of Litter Bins: 3 Items;13) Delivery And Assembly Of Playset No. 1: 1 Item;14) Delivery And Assembly Of The Platform Merry-Go-Round Ø 1500: 1 Item;15) Delivery And Assembly Of A Chain Swing: 1 Item;16) Delivery And Assembly Of Assembly Of Play Set No. 2: 1 Piece;17) Delivery And Assembly Of A Garden Rocker: 1 Piece;18) Delivery And Assembly Of A Metal Swing: 1 Piece.3. The Subject Of The Agreement Is Described In Detail In The Following Documents: 1) Construction Design For The Construction Of A Playground At Ul. G. Narutowicza In Sierpc; 2) Technical Specification Of Execution And Acceptance Of Works For The Construction Of A Playground At Ul. G. Narutowicz In Sierpc;3) Bill Of Quantities For The Construction Of A Playground At Ul. G. Narutowicz In Sierpc.4. In Order To Estimate And Evaluate The Scope Of Works, It Is Recommended To Additionally Manage: 1) The Results Of Detailed Site Inspections And Own Inventories; 2) The Results Of Own Tests And Measurements; 3) The Results Of Own Studies. The Contractor Grants The Ordering Party, In Accordance With § 8 Of The Agreement, A Quality Guarantee For The Performed Works And Installed Devices.6. The Rights Under The Warranty For Defects Are Vested In The Ordering Party For A Period Of 5 (Five) Years.7. Based On Article. 95 Sec. 1 Of The Public Procurement Law, In Connection With Art. 438 Of The Public Procurement Law, The Employer Requires The Contractor Or Subcontractor To Employ, Under An Employment Contract (Within The Meaning Of Article 22 § 1 Of The Act Of June 26, 1974 - Labor Code), Persons Performing Activities Related To The Performance Of The Contract, I.E. 1 Construction Worker .8. During The Performance Of The Order, The Ordering Party Is Entitled To Perform Verification And Control Activities Towards The Contractor Regarding The Fulfillment By The Contractor Or Subcontractor Of The Requirement To Employ Persons Performing The Activities Indicated In Point 7 Under An Employment Contract. The Ordering Party Is Entitled To: On The Basis Of An Employment Contract Of Persons Performing Activities In Connection With The Performance Of The Order, Specifying The Number Of People Employed Under An Employment Contract, Types Of Employment Contracts And Working Hours; Requirements;3) Carrying Out On-Site Inspections.9. Due To Failure To Comply With The Request Specified In Section 8 Point 1, The Ordering Party Will Charge Contractual Penalties Specified In § 7 Sec. 1 Point 9 Of The Agreement.10. The Employer Requires That The Remuneration For The Work Of Persons Employed On The Basis Of An Employment Contract Is Not Lower Than The Applicable Minimum Remuneration, Determined On The Basis Of The Provisions Of The Act Of 10 October 2002 On The Minimum Remuneration For Work.11. The Contractor And Its Subcontractors Are Required To Obtain Consent From Employees For The Processing Of Personal Data In Accordance With The Provisions On The Protection Of Personal Data.12. The Contractor Undertakes, At His Own Expense, To Prepare And Deliver After Completion Of The Works As-Built Documentation And Documents Required By The Construction Law To The Extent Related To Their Completion And Resulting From This Contract. The Contractor Also Declares That It Is An Entrepreneur Specializing In The Implementation Of Construction Investments Of A Nature Corresponding To The Intended Investment Task And The Subject Described In The Contract And Guarantees High Quality Of Works Related To The Implementation Of The Investment Task.13. The Contractor Declares That He Has Familiarized Himself With The Area Where The Subject Of The Agreement Is To Be Implemented And The Adjacent Area, And All Circumstances And Conditions Resulting From The Location Have Been Included By The Contractor In The Contractors Offer.14. The Contractor Is Obliged To Have And, At Each Request Of The Employer And The Supervision Inspector, To Present, For The Built-In And Used Materials And Devices, Appropriate Certificates And Attestations, In Particular: Certificate For The Safety Mark, Declaration Of Conformity, Declaration Of Performance Or Certificate Of Compliance With The Polish Standard Or Technical Approval, Certificates, And After The Performance Of The Contract, Submit Them To The Ordering Party.15. The Contractor Declares That He Conducts Business Activity Within The Scope Covered By The Agreement And That He Has Appropriate Logistics Facilities, Qualified Technical Staff As Well As Experience And Appropriate Executive Potential In The Field Of Execution Of Construction Works Being The Subject Of The Agreement And The Implementation Of All Provisions Of The Agreement.16. The Contractor Undertakes To Exercise The Utmost Diligence And Care For The Interests Of The Ordering Party When Performing The Subject Of The Agreement.17. According To Art. 100 Sec. 1 Of The Public Procurement Law, The Description Of The Subject Of The Contract Is Prepared Taking Into Account The Requirements Regarding Accessibility For People With Disabilities And Designing For All Users.
