1. The Subject Of The Order Includes The Purchase Of A Backhoe Loader With Additional Equipment (1 Piece) And Its Delivery To The Ordering Partys Headquarters. The Subject Of The Order Also Includes The First Start-Up Of The Backhoe Loader And Instruction In The Operation Of The Backhoe Loader. The Backhoe Loader And Additional Equipment Must Be Brand New And Manufactured From Brand New Elements, Unused, Complete, Free From Physical And Legal Defects And Must Meet The Requirements Specified By The Ordering Party In The Swz And Appendices To The Swz.2. A Detailed Description Of The Subject Of The Order, Including The Minimum Required Parameters And Requirements Of The Ordering Party Regarding The Backhoe Loader, Its Basic And Additional Equipment, Warranty And Service, Is Included In Annex No. 5 To The Swz. The Contractor Completes Appendix No. 5 To The Swz And Submits It With The Offer.3. The Task Is Co-Financed From The State Budget In The Form Of A Targeted Subsidy Under The Civil Protection And Civil Defense Program For 2025-2026. The Ordering Party Envisages Invalidation Of The Procedure Pursuant To Art. 310 Point 1 Of The Public Procurement Law, If These Funds Are Not Granted To Him.4. The Subject Of The Order Was Not Divided Into Parts. The Ordering Party Does Not Allow The Submission Of Partial Offers. Reasons For Not Dividing The Order Into Parts (Article 91(2) Of The Public Procurement Law): The Subject Of The Order Is The Delivery Of One Working Machine With Basic And Additional Equipment Adapted To The Quick Coupler And Hydraulic Installation Of This Machine And Constituting A Technical And Functional Whole With It. Dividing The Order Into Parts Is Not Justified For Technical Reasons And Would Also Make It Difficult To Exercise Warranty And Service Rights.5. The Contractor Is Obliged To Complete The Order On The Terms And Conditions Described In The Draft Provisions Of The Contract Constituting Annex No. 4 To The Swz.
