1. The Subject Of The Order Is The Supply Of Equipment To A Nursery Located In Wieliczka At The Following Address: Ul. Artura Grottgera 6C, 32-020 Wieliczka And Includes Deliveries, In Particular, Of Furniture Equipment. A Detailed Description Of The Equipment And Their Quantity Is Included In Annex No. 4A To Swz.2. Terms Of The Order Common To All Parts Of The Order: 2.1) Delivery Should Be Made To The Nursery Building Located At Ul. Artura Grottgera 6C 32-020 Wieliczka In Quantities And Assortment Consistent With The Description Of The Subject Of The Order, And Includes Delivery And Bringing Into The Indicated Room And Carrying Out The Necessary Works In Terms Of Assembly (If Required), Arrangement, Connection And Commissioning In The Place Indicated By The Ordering Party, While The Date Of Acceptance Will Be The Transfer Of The Complete Assembled Or Installed Equipment And Equipment And The Signing Of The Final Acceptance Protocol By The Ordering Party. 2.2) The Contractor Will Deliver The Subject Of The Order With His Own Means Of Transport, At His Own Expense And Risk. The Contractor Bears Full Responsibility For Any Damage Occurring During Transport. The Contractor Bears All Costs Related To The Delivery Of The Subject Of The Contract To The Ordering Party And Is Responsible For The Subject Matter Of The Contract (Risk Of Loss, Damage, Etc.) Until It Is Received By The Ordering Party.2.3) All Delivered Equipment, Devices, Equipment Should Be Brand New, Unused, Without Physical And Legal Defects, Including Any Rights Of Third Parties And Any Other Encumbrances And Security Measures, And Should Have And Meet All The Requirements Indicated In The Tor And Annexes To The Full Extent Specified.2.4) Return Of Goods That Are Not Suitable For Use And Delivery Of Replacement Goods, Free From Defects And Defects, Will Be At The Expense Of The Contractor. The Contractor Will Replace The Part Of The Subject Of The Contract Not Accepted During The Final Acceptance With A New One With The Same Parameters And Type Within The Time Specified By The Ordering Party, At Its Own Expense. 2.5) If A Trademark, Patent Or Phrase Indicating The Origin, Source Or Specific Process That Characterizes The Subject Of The Contract Is Used To Describe The Subject Of The Contract Contained In The Contract Notice, Specifications Of The Contract And Annexes To The Specifications Of The Contract, The Ordering Party Indicates That It Allows The Use Of Solutions Equivalent To Those Described. The Contractor Who Refers To Solutions Equivalent To Those Described By The Ordering Party Is Obliged To Demonstrate That The Equivalent Solutions Offered By Him Meet The Requirements Specified By The Ordering Party. 2.6) The Minimum Warranty Period Is Specified In Annex 4A To The Swz. The Warranty Period Is Counted From The Date Of Signing The Equipment Transfer Protocol By Both Parties. The Warranty Period Must Correspond To The Period Of The Warranty Granted.
