Financial And Insurance Services – Company Bike Leasing For Dak-Gesundheit Employees. (1) The Subject Of The Contract Is The Provision Of Bicycles By Way Of Leasing For The Purpose Of Providing Them To Dak-G Employees Throughout The Federal Republic Of Germany For Business And Private Use, Including Insurance And Services, As Well As All Associated Activities And Services In Accordance With The Requirements Set Out In The Service Description. (A) This Applies In Particular To The Handling Of The Ordering, Termination, Return And Claims Processing Processes, Coordination And Management Of Relationships/Services, Inspection Services And - As Purely Optional Services - Maintenance Services (Wear Repairs). (B) The Contractor Must Ensure A Germany-Wide Network With At Least 5,000 Stationary Specialist Bicycle Dealers (Section 2.1 Of The Service Description) Throughout The Entire Contract Period, So That All Dak-G Employees Can Visit A Suitable Bicycle Dealer Throughout The Federal Republic Of Germany And Choose A Bicycle, Which Dak-G Can Then Lease [Must]. In Addition, The Contractor Can Also Offer Online Specialist Retailers [Voluntary/Can]; These Do Not Count Towards The Mandatory Number Of At Least 5,000 Stationary Specialist Bicycle Dealers. (C) The Contractor Provides Dak-G With An Online Portal For The Implementation/Processing Of The Company Bike Leasing, Which Complies With The Specifications Of The Service Description. The Online Portal Used Must Necessarily Correspond To The Contractors Written Representations Regarding The Online Portal, Including The Online Portal In The Form Of Test Access, Which Were Submitted Or Made Available With The Offer, Throughout The Entire Contract Term. (D) The Contractor Ensures That The Performance Of The Service Is In Accordance With All Statutory, Official And Other Legal Regulations And Can Be Carried Out In Accordance With The Purpose. If This Is No Longer Possible Or Only Possible To A Limited Extent, He Must Inform Dak-G Immediately. The Parties Then Agree On How To Proceed. The Above Applies In Particular If The Permission In Accordance With Section 32 Kwg To Provide Finance Leasing Within The Meaning Of Section 1 Paragraph 1A Sentence 2 No. 10 Kwg Is No Longer Available. (E) Details On The Type, Scope And Content Of The Service Can Be Found In The Service Description (Appendix B1) And The Price Sheet (Appendix B3). (2) To Ensure A Uniform Range Of Company Bikes, A Uniform Service Provider/Contractor (Lessor And Service Provider With Specialist Dealers And Insurance Service Providers) Should Be Commissioned. The Contractor Can Be A Service Provider Who Is Himself A Lessor Or Involves A Leasing Company As A Subcontractor (So-Called Third Party In Accordance With Section 12). Alternatively, The Contractor Can Be A Bidding Consortium Consisting Of A Service Provider And A Leasing Company
