Various Medicinal Products – Supply Of Drugs For The Cftr Modulators Drug Program To The Independent Complex Of Public Health Care Facilities In Dziekanów Leśny. A Detailed Description Of The Subject Of The Order Is Included In This Tor And: 1) Annex No. 1 - Offer Form; 2) Annex No. 2 – Assortment And Price Form; 3) Annex No. 3 - Draft Contract. The Ordering Party Reserves The Right To Not Fully Implement The Contract In The Scope Of A Given Part. The Order Will Be Implemented In Accordance With The Current Needs Of The Ordering Party. However, The Value Of The Parties Performance Will Not Be Lower Than 20% Of The Total Gross Value Of The Subject Of The Agreement. The Above Does Not Apply In The Event Of Withdrawal From The Agreement Or Termination Of The Agreement By The Ordering Party As A Result Of Circumstances Attributable To The Contractor Or Beyond The Will Of The Parties. The Ordering Party Reserves The Right To Change The Quantity Of The Ordered Product Within The Total Gross Value Of The Subject Of The Agreement. The Ordering Party Requires The Submission Of The Said Evidence. The Ordering Party Requests That The Contractor Submit, Together With The Offer, The Following Pieces Of Evidence To Confirm That The Offered Supplies Meet The Requirements Specified By The Ordering Party In The Swz (In Particular In The Description Of The Subject Of The Order): 1) The Contractors Declaration That The Offered Medicinal Product Has A Valid Marketing Authorization In The Territory Of The Republic Of Poland - Prepared According To The Template Constituting Annex No. 8 To The Swz. The Ordering Party Provides For The Possibility Of Supplementing The Evidence If The Contractor Fails To Submit The Evidence Or The Evidence Submitted Is Incomplete. The Contractor May Supplement The Evidence In Question, But Only At The Request Of The Ordering Party. Pursuant To The Content Of Art. 107 Section 2 Of The Public Procurement Law, The Ordering Party Has The Right To Request The Contractor To Submit Or Supplement The Evidence Specified In Section 2 Point 1 Of The Above-Mentioned Evidence If The Contractor Has Not Submitted The Evidence Or The Evidence Submitted Is Incomplete. The Ordering Party Accepts Equivalent Means Of Evidence If They Confirm That The Services Offered Meet The Requirements, Features Or Criteria Specified By The Ordering Party. The Ordering Party Provides For The Possibility Of Asking The Contractor To Explain The Evidence In Question. The Ordering Party Does Not Call For Supplementation Or Clarification Of The Evidence In Question If The Contractors Offer Is Subject To Rejection Regardless Of Its Submission Or If There Is A Reason To Invalidate The Proceedings. (Article 107(3) Of The Public Procurement Law).
