1. The Subject Of The Order Is To Provide Software Licenses For Laboratory Stations With Licenses For Measurements Of 4G Radio Communication Systems As Part Of The Project Entitled Public Security Technology Center No. Feds.01.01-Iz.00-0003/24.2.A Detailed Description Of The Subject Of The Order Can Be Found In Annex No. 3 To The Swz - Opz.3.The Detailed Scope Of Performance Of The Subject Of The Contract, Which Is The Draft Provisions Of The Public Procurement Contract, Is Included In The Contract Template Constituting Annex No. 2 To The Swz. 3. Export Restrictionsthe Contractor Is Obliged To Ensure That The Offered Subject Of The Order Can Be Exported, Re-Exported, Transferred And Delivered To The Wrocław University Of Science And Technology In Accordance With Applicable Regulations. In The Case Of Products, Their Components, Software Or Technologies Subject To Export Control Regulations, In Particular Dual-Use Products Originating From The Peoples Republic Of China, The Contractor Is Obliged, Before Submitting The Offer, To Verify The Possibility Of Their Legal Delivery To The Ordering Party. If The Delivery Requires Obtaining A Permit, License Or Other Consent Of The Competent Authority, The Obligation To Obtain It, At Its Own Expense And Risk, Rests With The Contractor. The Contractor Cannot Offer A Product Whose Delivery To The Wrocław University Of Science And Technology Is Prohibited By Law. At The Request Of The Ordering Party, The Contractor Will Be Obliged To Present Documents Issued By The Chinese Ministry Of Commerce (Mofcom) Or Competent Authorities Confirming The Possibility Of Lawfully Delivering The Offered Goods To The Wrocław University Of Science And Technology. The Contractor Is Liable For The Consequences Of Non-Performance Or Improper Performance. Execution Of The Order Resulting From Export Restrictions Existing And Possible To Determine On The Date Of Submission Of Offers.
