1. The Subject Of The Order Is Modernization Of The Access Road To Agricultural Land On Plot No. 15, 17, Karpno District, Lipnica Commune Over A Length Of Approx. 500 M. The Investment Involves The Construction Of A New Mineral And Bituminous Surface With A Road Width Of 3.5-4.0 M With Passing Lanes Widening The Road By 5.0 M And Both Sides Of Crushed Aggregate Roadsides. (2*0.75 M) And Exits Within The Road Surface With A Road Surface. Bituminous Surfaces Made On A Crushed Aggregate Base. The Subject Of The Order Is Intended For All Users And Takes Into Account The Requirements Of Disabled People. All Used Elements Are To Be Brand New, Approved For Trade And Have All Certificates Of Approval For Use. Additionally, The Elements Used Should Meet Safety Standards Specified By Law. The Materials And Devices Used Should Comply With Declarations Of Compliance With Polish Standards, Certificates And Technical Approvals. The Proper Names Provided In This Swz And Its Annexes (Origin, Manufacturer, Etc.) Are Only Of Auxiliary Nature To Determine The Basic Parameters And Features Of The Materials, Products, Devices And Equipment Used. The Ordering Party Allows The Use Of Solutions Equivalent To The Provisions Of The Public Procurement Law, Including Art. 101. An Equivalent Product Is One That Has The Same Functional Features As A Specific Product By Name Or Origin Indicated In The Documentation. Its Quality Cannot Be Worse Than The Quality Specified In The Product Specification And Construction Documentation, And It Should Have Parameters No Worse Than Those Of The Indicated Product. The Law Applicable To This Order (Including The Contract Concluded As A Result Of These Proceedings And For The Assessment Of The Legal Effects Of All Documents In This Order) Is Polish Law, Taking Into Account European Union Law. In All Provisions Of The Swz And All Its Annexes In Which The Ordering Party Refers To Standards, Approvals, Technical Specifications Or Reference Systems Or Indicates Trademarks, Parameters Or Sources Of Origin (Names Of Manufacturers Or Devices), In Accordance With Art. 99 Section 5 And Art. 101 Section 4 Of The Public Procurement Law, The Ordering Party Allows Equivalent Solutions. If The Annexes Constituting The Description Of The Subject Of The Order Include The Names Of Materials, Products Of Specific Manufacturers, And Standards, This Should Be Treated Only As A Definition Of The Desired Standard And Quality. In All Such Situations, The Contractor May Offer Equivalent Materials And Products With At Least The Same Technical And Quality Parameters. Product Equivalence Means Offering A Product Whose Technical Parameters Of The Materials Used, Efficiency, Durability And Quality Are Not Inferior To The Quality Of The Materials And Products Described In The Swz. The Contractor Who Refers To Equivalent Solutions Is Obliged To Demonstrate That The Solution He Offers Meets The Requirements Specified By The Ordering Party. In Such A Case, The Contractor
