1. The Subject Of The Order Is The Performance Of Design And Construction Works Related To The Construction Of A Fence On The Premises Of The Gks Rozbark Facility In Bytom At Ul. In The Design-Build System. Tuwima 43. A Detailed Description Of The Subject Of The Order Is Included In The Functional And Utility Program, Constituting Annex No. 5 To The Swz. Detailed Terms And Conditions Of The Contract Are Included In The Draft Provisions Of The Contract, Constituting Annex No. 4 To The Swz.2. The Contractor Is Obliged To Provide The Ordering Party With A 36-Month Warranty And Guarantee For The Design Work Performed And Other Documents Developed Under The Subject Of The Contract, For The Construction Works Performed And For The Construction Materials, Installations, Devices And Equipment Used, Counted From The Date Of Final Acceptance Of The Works, Under The Conditions Specified In The Draft Provisions Of The Contract, With The Reservation That The Contractor May Offer A Longer Warranty And Warranty Period, Which Will Be Assessed As Part Of The Offer Evaluation Criteria (See: Part Xviii Of The Swz). 3. The Contractor Is Obliged To Employ, On The Basis Of An Employment Contract, All Persons Performing Construction Works, Such As: Disassembly, Assembly, Installation, General Construction Works And Other Works Listed In The Bill Of Quantities Prepared By The Contractor, For The Performance Of Which No Authorizations Are Required. Above The Obligation Does Not Apply To Entrepreneurs Personally Performing Any Of The Above. Workers, Collaborators Within The Meaning Of The Act Of October 13, 1998 On The Social Security System, As Well As Members Of The Contractors Management Or Supervisory Bodies, Partners Of A General Partnership Or Partnership To The Extent That They Will Personally Perform The Service For The Ordering Party Or The Contractor. The Above Applies Accordingly To Subcontractors. Determining The Method Of Documenting The Employment Of These People, The Employers Rights To Control Compliance And Sanctions For Failure To Meet These Requirements Are Specified In The Draft Contractual Provisions. 4. The Ordering Party Does Not Reserve The Obligation For The Contractor To Personally Perform The Key Part Of The Order. The Contractor May Entrust The Execution Of Part Of The Order To A Subcontractor. The Contractor Should Indicate In The Offer The Parts Of The Order The Performance Of Which He Intends To Entrust To Subcontractors And Provide The Names Of Any Subcontractors, If They Are Already Known. Entrusting The Performance Of Part Of The Order To Subcontractors Does Not Release The Contractor From Responsibility For The Proper Performance Of This Order.5. The Ordering Party Does Not Allow The Possibility Of Submitting Partial Offers.
