Subject Matter Of The Order: 1) The Subject Of The Order Is A Service Consisting In The Removal Of Trees And Shrubs Along With Grubbing Up In The Area Of ​​The Northern Outer Ward Of The Castle Museum In Malbork As Part Of The Project Improving The Tourist Attractiveness Of The Historic Buildings Of The Northern Outer Ward Of The Castle Complex In Malbork By Carrying Out Conservation And Construction Works Along With Land Development In Their Surroundings. 2) A Detailed Description Of The Subject Of The Order Is Attached As Annex No. 1 To The Swz, I.E. The Draft Contract With Attachments, I.E. Annex No. 1 To The Contract - Description Of The Subject Of The Order, Annex No. 2 To The Contract - The Material And Financial Schedule. 3) The Castle Museum In Malbork Obtained Funding For The Project From The European Funds For Infrastructure, Climate, Environment 2021-2027 Program, Project Number Fenx.07.01-Ip.04-0059/24. The Order Is Covered By The Project Entitled Improving The Tourist Attractiveness Of The Historic Buildings Of The Northern Outer Bailey Of The Castle Complex In Malbork By Carrying Out Conservation And Construction Works Together With Land Development In Their Surroundings. The Order Is Covered By The Project, But The Cost Is Ineligible In Accordance With The Project Regulations. 2. Information About Parts Of The Order The Ordering Party Divided This Order Into Parts. The Ordering Party Initiates Proceedings For Greenery Services, Including Tree Cutting In Parts, This Order Is Part No. 3. However, This Order Is Not Divided Into Smaller Parts Due To The Nature Of The Order And Its Scope. The Order Is A Homogeneous Order And Performed In The Same Area On Dates And Hours Adapted To Tourist Traffic And Construction Works Within Which Felling Will Be Carried Out, Which Requires Appropriate Coordination On The Part Of The Ordering Party. The Time In Which A Given Felling Must Be Carried Out, Including The Cleaning Of The Area When More Than One Contractor Is Working, Could Result In Improper Coordination Of The Works, As Well As The Destruction Of The Historic Substance On Which The Felling Will Be Carried Out. Moreover, The Order Size Is Adjusted To Contractors From The Sme Group, Which Increases Competition. Dividing This Contract Into Smaller Parts Could Prove Unprofitable For Sme Contractors To Complete. Therefore, There Are No Grounds To Divide This Order Into Smaller Parts. 3. Requirement For Employment Under An Employment Contract 1) The Ordering Party, Pursuant To Art. 95 Section 1 Of The Public Procurement Law Requires The Contractor Or Subcontractor To Employ, On The Basis Of An Employment Contract (Employment Contract Within The Meaning Of Article 22 § 1 Of The Act Of June 26, 1974 - Labor Code) Persons Performing Activities Involving The Provision Of Investor Supervision Services, If These Activities Correspond To The Terms Of The Employment Contract And Are Not Performed On Commission As Part Of The Business Activity Run By A Given Person. 2) Detailed Provisions Regarding The Fulfillment Of The Requirement Of Art. 95 Section 1 Of The Public Procurement Law Are Regulated
