Pharmaceutical Products – Conclusion Of Non-Exclusive Discount Agreements In Accordance With Section 130A Paragraph 8 Sgb V For Pharmaceuticals (Open House Procedure). The Procurement Requirement Includes All Medicinal Products With The Active Ingredients Named In Appendix 3 To The Conditions Of Participation (So-Called List Of Active Ingredients And Deadlines). The Procurement Requirements Were Not Divided Into Lots. This Is An Open House Procedure. To The Extent That Wording Is Used In This Announcement That Indicates The Division Of Procurement Requirements Into One Or More Lots, This Is Solely Due To The Specifications Of This Announcement Form. In This Context, Reference Is Made To The Non-Applicability Of Procurement Regulations Described At The Beginning Of Section 2.1. The Aok Starts The Open House Process Based On The Serial Numbers In Appendix 3 To The Conditions Of Participation With The Following Active Ingredients (So-Called Starting Active Ingredients): Serial. No. 1: Aripiprazole In Extended-Release Dosage Forms (Atc Code N05ax12); Ongoing No. 2: Epoetin Alfa; Serial No. 3: Epoetin Beta; Serial No. 4: Epoetin Zeta; Serial No. 5: Peg-Epoetin Beta; Serial No. 6: Glatiramer Acetate; Serial No. 7: Lisdexamfetamin Dimesilate In The Dosage Form Hard Capsule Exclusive Pack Size 30 Pieces*. *The Procurement Requirements Only Include The Hard Capsules In Pack Sizes Of 90 And 100 Pieces. The Aok Reserves The Right To Adjust The Procurement Requirements Of This Open House Process In The Course Of The Process By Adding Additional Active Ingredients To Annex 3 To The Conditions Of Participation Or Reducing Individual Active Ingredients. In The Event Of An Expansion Of Procurement Requirements, Discount Agreements For Medicinal Products With These Additional Active Ingredients Would Also Become The Subject Of The Present Open House Procedure. Of Course, This Would Not Expand The Content Of Contracts Already Concluded For Other Active Ingredients, But Rather A New Contract Would Have To Be Concluded For Each Active Ingredient (See Also Sections A.I.1 And A.Iii.4 Of The Conditions Of Participation). If The Client Wishes To Terminate All Discount Agreements For An Active Ingredient From Annex 3, It Can Declare This To All Discount Contract Partners For This Active Ingredient At The Same Termination Time And Cancel The Open House Procedure For The Same Active Ingredient. In This Case, The Aok Will Immediately Announce The Cancellation Of This Open House Procedure For The Same Active Ingredient In The Supplement To The Official Journal Of The European Union. Alternatively, Aok Is Entitled To Conclude New Discount Agreements For The Same Active Ingredient With Changed Conditions After A Subsequent Announcement. Further Information On A Possible Adjustment Of Procurement Requirements Is Contained In The Conditions Of Participation (Section A.I.4). Contracts For Medicines With The Starting Active Ingredients Will Not Be Concluded Until January 1, 2027 At The Earliest. All Discount Agreements Concluded As Part Of This Open House Procedure End On December 31, 2028. For The Earliest Possible Start Of The Contract On January 1St, 2027, Interested Companies Must Submit An Application In Accordance With The Participation Documents By November 20Th, 2026 At The Latest
