1. The Subject Of The Order Is The Supply Of Brand New Induction Loops With Headphones And Bluetooth Headphones To The Police Training Center In Legionowo. Basic Order: 1) Induction Loop With Handset – 35 Sets, 2) Bluetooth Handset – 40 Sets. Optional Order: 1) Induction Loop With Handset – Maximum 5 Sets, 2) Bluetooth Handset – Maximum 10 Sets.2. The Ordering Party Provides For The Possibility Of Exercising The Option Right Referred To In Art. 441 Of The Act. The Option Right May Be Used Only After 100% Of The Value Of The Basic Order Has Been Completed, If There Are Financial Resources And There Is A Need To Order A Larger Quantity Of The Subject Of The Order In Relation To Those Provided For In The Basic Scope. The Value Of The Contract Awarded Under The Option Right Depends On The Financial Resources Available.3. The Ordering Party Provides For The Possibility Of Exercising The Option Right To The Extent Indicated In The Order Documents, At The Prices Specified In The Offer, Subject To The Provisions Of The Draft Contract, Constituting Annex No. 5 To The Swz.4. The Ordering Party Reserves That The Part Of The Order Defined As An Option Right Is An Entitlement, Not An Obligation, Of The Ordering Party. The Option May Or May Not Be Exercised, Depending On The Financial Capabilities Of The Ordering Party. Failure To Complete The Order In This Respect Will Not Result In Any Claims From The Contractor.5. The Ordering Party Requires That The Offered Subject Of The Order: 1) Be Brand New, Produced In The Current Year For Delivery, Without Any Signs Of Damage, Of Full Value; 2) Have Technical And Functional Parameters Not Worse Than Those Indicated In Annex 4 To The Swz - Description Of The Subject Of The Order; 3) Be Marked With The Ce Mark; 4) Be Free From Legal And Technical Defects That Prevent Their Use In Accordance With Their Intended Purpose; 5) Do Not In Any Way Violate Patent Rights Or Other Intellectual Property Rights Of Third Parties; 6) Was Placed In The Manufacturers Original Packaging Protecting It Against Mechanical Damage;7) Came From A Legal Distribution Channel To The Territory Of The Republic Of Poland.8. The Ordering Party Requires The Contractor To Provide, On The Day Of Delivery, Documentation In Polish For Each Product, Including: 1) A Warranty Card Containing The Serial Numbers Of The Product, The Date And Conditions Of Warranty Validity, E-Mail Addresses, Fax Numbers To Which Repair Notifications Can Be Made And Telephone Numbers Where All Information Regarding The Repair Can Be Obtained, 2) An Operating Manual In Polish.9.
