The Subject Is The Purchase And Delivery Of Toners, Color Ribbons And Consumables, Unused, Undamaged, Free From Physical And Legal Defects In The Manufacturers Original Packaging, With A Visible Name Of The Device For Which The Product Is Intended, With The Product Symbol, Catalog Number, With All Tightness Protection Of Toner Tanks, And In The Case Of Items Manufactured With A Shelf Life, With An Expiry Date Of At Least 12 Months From The Date Of The Protocol Transfer.A Detailed Description Of The Subject Of The Order, Including The Type Of Equipment Used By The Ordering Party And The Type Of Consumable Material Recommended By The Equipment Manufacturer, As Well As The Quantity Of The Ordered Goods/Range, Is Included In The Price And Technical Form Constituting A Detailed Opz - Annex No. 1 To This Instruction For Contractors: A) Toners, Color Ribbons And Consumables For Printing Devices Requiring The Use Of Original Toners And Consumables On The Basis Of Separate Contracts. B) Toners And Consumables For Printing Devices Requiring The Use Of Original Toners/Consumables Under Warranty And/Or Used In Tasks Requiring High Print Quality. 2. If The Description Of The Subject Of The Order Indicates Any Own Names And Trade Brands Of Devices Or Consumables, Trademarks, Patents Or Origin - It Should Be Assumed That The Indicated Own Names And Trade Brands Of Devices Or Consumables, Patents, Trademarks, Origin Specify The Technical, Operational And Utility Parameters Were Used To Specify The Quality And Technological Expectations Of The Ordering Party, The Technological Names Or Manufacturers Of Key Components Included In The Specification Were Used Only For Example Purposes - Which Means That The Ordering Party Allows Submitting An Offer In Which Individual Devices Or Materials Listed In The Description Of The Subject Of The Order May Be Replaced By Equivalent Devices Or Materials/Elements, I.E. The Subject Of The Order With Technical, Operational And Utility Parameters Not Worse Than Those Proposed By The Ordering Party. Pursuant To Art. 101 Of The Act On Public Procurement, If The Description Of The Subject Of The Contract Indicates Specific Solutions In Terms Of Features, Parameters Or Technical Solutions, The Ordering Party Allows The Use Of Devices And Products Or Technical Solutions Equivalent In Terms Of Their Features, Parameters, Standards Or Technical Solutions. The Use Of Equivalent Solutions Cannot Lead To A Deterioration Of The Properties Of The Subject Of The Contract. The Obligation To Prove Equivalence Lies With The Contractor In Accordance With Art. 104 Above Public Procurement Law - By Attaching To The Offer, E.G. Product Cards, Catalogues, Manufacturers Descriptions, Etc. - I.E. Descriptions That Will Unequivocally Confirm The Equivalence Of The Products In Terms Of Their Features, Parameters Or Technical Solutions.
