1. Note: Pursuant To Art. 257 Of The Act Of 11 September 2019 - Public Procurement Law, The Ordering Party Reserves The Right To Invalidate The Public Procurement Procedure In Question In The Event That The Public Funds That The Ordering Party Intended To Allocate To Finance The Contract Are Not Awarded To It, In Whole Or In Part, Within The Time Limit Enabling The Conclusion Of The Contract. In Such A Case, The Contractors Are Not Entitled To Any Claims Against The Ordering Party, In Particular For Reimbursement Of The Costs Of Participation In The Proceedings.2. The Subject Of The Contract Are Construction Works Consisting In The Construction Of A Building Serving As A Station Of The Emergency Medical Services Team Using Renewable Energy Sources Along With Accompanying Infrastructure, Access Roads, Maneuvering Area, Parking Spaces, Fencing, Garbage Cover, Green Lawn Areas, Plantings Located On Plot No. 77/7, Rev. 0003, Am-1, Lubań.3. The Ordering Party Informs That Construction Works As Part Of The Planned Investment Will Be Carried Out In The Vicinity Of The Building Where The State Fire Service Headquarters Operates. Due To This Fact, The Contractor Is Obliged To Agree On The Schedule And Scope Of Subsequent Construction Works With The User And Present The Schedule Prepared In This Way To The Ordering Party. The Contractor Is Obliged To Carry Out Construction Works In Such A Way As To Minimize The Nuisance Of The Works, In Particular In The Context Of Hindering The Functioning Of The State Fire Service Unit.4. Due To The Nature Of The Place And The Possibility Of Third Parties Moving Or Staying In The Building And On The Area Within Which Construction Works Will Be Carried Out, The Contractor Should Absolutely Exercise Special Caution During The Works And During The Transport And Unloading/Loading Of Materials, Equipment And Devices, As Well As Waste. The Contractor Should Take Particular Care To Secure The Construction Site To Ensure The Safety Of Third Parties And Their Property.5. A Detailed Description Of The Subject Of The Order Is Included In The Annexes To The Terms Of Reference, I.E. Technical Documentation, Which Consists Of: 1) Description Of The Subject Of The Order - Annex No. 5 To The Terms Of Reference; 2) Technical Documentation, Including: Technical Specification For The Execution And Acceptance Of Works, Drawings, 6. The Ordering Party Requires The Contractor To Provide: 1) A Warranty For The Construction Works Performed For A Period Of At Least 36 Months From The Date Of Final Acceptance Of The Subject Of The Contract; 2) Warranty For Defects In The Subject Of The Contract For A Period Of At Least 60 Months From The Date Of Final Acceptance Of The Subject Of The Contract.7. Note: The Warranty Period Referred To In Section 6, Is One Of The Scoring Criteria For The Evaluation Of Offers, Hence The Contractor May Extend The Offered Warranty Period For The Completed Construction Works - On The Terms Specified In Section Xx Of The
