1. The Subject Of The Order Is: Delivery And Commissioning Of A Mobile Power Generator, Carried Out As Part Of The Cybersecure Local Government Project And Financed By The European Regional Development Fund (Erdf) Under The European Funds For Digital Development 2021-2027, Priority Ii Advanced Digital Services, Measure 2.2. Strengthening The National Cybersecurity System. The Detailed Scope Of The Order Was Specified In Annex No. 4 To The Swz. 2. Equivalence: A) The Ordering Party, In The Case Of Describing The Subject Of The Contract Using Trademarks, Standards, Patents Or Origin, Source Or Specific Process Referred To In Art. 101 Section 4-5 Of The Act, Indicates That It Allows Solutions Equivalent To Those Described In Terms Of The Adopted Technical Solutions, Materials, Products And Standards Used, Provided That Those Proposed In The Offer Are Significantly Equivalent To Those Specified In The Design Documentation. B) If The Description Of The Subject Of The Order Contains Any Trademarks, Patents, Standards Or Other Reserved Or Exclusive Rights, Or The Origin Of The Subject Of The Order Or Its Part Is Specified - It Should Be Assumed That The Ordering Party, Due To The Specific Nature Of The Subject Of The Order, Has Provided Such A Description With An Indication Of The Type And Allows The Submission Of Offers Equivalent In Terms Of Functionality And With Technical And Utility Parameters Not Worse Than Those Given In The Description Of The Subject Of The Order. If An Offer Is Submitted Containing The Use Of Solutions Equivalent To Those Described By The Ordering Party, The Obligation To Prove Their Equivalence With The Requirements Specified By The Ordering Party Rests With The Contractor. In Such A Case, The Contractor, Together With The Offer (Not Subject To Supplementation), Will Submit A List Of Equivalent Materials Together With Other Necessary Documents Confirming The Fulfillment Of The Above-Mentioned Requirements, E.G. Device Cards, Safety Certificates, Declarations Of Conformity, Technical Approvals, Etc. C) The Ordering Party Will Consider The Products Offered By The Contractor To Be Equivalent In Terms Of Functionality, Technical And Utility In Relation To The Indicated Subject Of The Order, Those Products Offered By The Contractor Which Have A Technically Equivalent Structure And Equipment, As Well As Such Functional Capabilities. And Technical Parameters Including Products With The Given Reference Parameters Included In The Description Of The Subject Of The Order. D) The Ordering Party Made Every Effort To Maintain Competitive Conditions. However, If Proper Names, Markings Or Parameters Indicating A Specific Product Appear In The Text Of Any Type Of Documentation, They Should Always Be Treated As Exemplary Solutions And Equivalent Solutions May Be Used Under The Conditions Adopted Above. E) If The Contractor Does Not Submit Documents Regarding The Use Of Other Materials And Devices, It Is Understood That The Materials And Devices
