System And Support Services – Providing Support And Updating Of The Fudo Security It Solution, Including The Functionality Of Monitoring And Recording Remote Sessions Connected To It Systems And Providing Other Services. 1. The Subject Of The Order Is To Provide Support And Update Of The Fudo Security It Solution, Including The Functionality Of Monitoring And Recording Remote Sessions Connected To It Systems, And The Provision Of Other Services. 2. The Subject Of The Order Includes In Particular: A. Provision Of Technical Support Services For The System Owned By The Units, In Accordance With The Requirements Specified In Point. Iii Opz, Including The Provision Of The Following Services: Updates, Knowledge Base And System Maintenance, B. Providing Or Granting Any Licenses Under The Terms Specified In The Agreement, C. Providing Technical Assistance Within The Pool Of Up To 500 Man-Hours (Under The Option Right). 3. A Detailed Description Of The Subject Of The Order Is Attached As Annex No. 2 To The Swz. 4. Detailed Terms And Conditions Of The Provision Of Services Are Included In The Template Agreement Constituting Annex No. 5 To The Swz. 5. The Ordering Party, Acting Pursuant To Art. 95 Section 1 Of The Public Procurement Law Requires The Contractor Or Subcontractor To Employ, On The Basis Of An Employment Relationship, All Persons Performing: A. Activities Of The Person Designated By The Contractor As Responsible For Servicing The Agreement, Indicated In § 10 Of The Agreement, Consisting Of, Among Others: On Ongoing Contact With The Ordering Party And The Units, B. Activities Involving The Handling And Management Of Service Requests Submitted By The Units On The Terms And Within The Scope Specified In The Template Agreement Constituting Annex No. 5 To The Swz. 6. The Meaning Of The Terms Used In This Swz Is Identical To The Definitions Adopted In The Template Agreement Constituting Annex No. 5 To The Swz. 7. The Ordering Party Allows As An Equivalent Solution The Delivery Of The System For Recording Remote Sessions Together With The Substitute Equipment Necessary For The Proper Operation Of The System In Accordance With The Description Of The Subject Of The Order And The Transfer To The Recipient And The Units Of The Ownership Of The Substitute Equipment Together With The Software (Equivalent Software, Other Than Fudo Security) And Granting Or Ensuring The Granting Of Perpetual Licenses For The Software Necessary For The Proper Operation Of The System. In Such A Case, The Contractors Responsibilities Include The Development Of An Implementation Project Including Installation And Configuration Of The System And Integration With Systems Currently Operating At The Recipients And In The Units, Launching And Configuring The Substitute Hardware And Software Based On The Assumptions Of The Implementation Project In 12 Independent Locations Of The Units, Along With The Migration Of All Data And The Entire Current Configuration, Including Authorizations And Existing Recordings, Conducting On-The-Job Training For Up To 6 People On The Functioning Of The Delivered System. Equivalent And Administering It In 12 Independent Locations Of The Units, Providing A Warranty For The Period From Signing The System Implementation Acceptance Protocol Until The Expiry Of The 36Th Month Of Provision Of Technical Support Services, Under Which Service Care Will Be Provided For The Delivered And Launched System Together With The Equipment Necessary For
