The Tendered Framework Agreement Deals With The Supply Of Ostomy, Compression And Tai Products (Ostomy Products) To The Municipalities Own Stocks, If Any, Supply Of Ostomy Products To Citizens And - On The Basis Of The Winning Tenderers Unit Prices In Appendix 3A - List Of Tenders - Determination Of The Municipalities Subsidy To Citizens With A Grant. Purchase Of Ostomy Products Will Primarily Be Made By Citizens On The Basis Of The Municipalities Grant To Citizens. In Connection With The Grant To Citizens, The Municipalities Will State That Citizens Can Purchase The Granted Products Without Out-Of-Pocket Payment From The Winning Tenderer. The Selected Supplier Will Thus Function As The Municipalities Primary Contract Supplier And Reference Basis For Subsidy Determination. The Ordering Party Intends To Enter Into The Framework Agreement With One Supplier. . Citizens Purchases Of Ostomy Products Are Covered By §112 Of The Service Act, Which Means That Citizens Have A Free Choice Of Supplier, And Which Means That The Framework Agreement Is Non-Exclusive For The Supplier. Since Ostomy Products Are Covered By §112 Of The Service Act, And Since Citizens Needs For These Aids Vary Over Time, The Municipalities Cannot Guarantee The Supplier A Specific Volume During The Term Of The Framework Agreement. In Connection With Issuing A Grant, The Municipality Will Inform The Citizen That The Citizen Has A Free Choice Of Supplier, But That It Is Possible To Buy The Approved Products From The Supplier Without Paying Out-Of-Pocket. The Service Acts Provisions On Free Choice Of Supplier Also Mean That The Municipality, Where The Citizen Chooses A Supplier Other Than The Winning Tenderer To Deliver The Products, Does Not In All Cases Have The Opportunity To Maintain Confidentiality Regarding Unit Prices. The Municipalities Are Obliged To State The Granted Subsidy For Ostomy Aids On The Grant, And This Amount Will Follow The Unit Prices From The Winning Tenderer. The Following Municipalities Have Joined Forces To Offer A Framework Agreement Regarding The Supply Of Ostomy Products Etc. Cf.
