Electricity – Electricity Supplies For The Port Of Gdynia In 2027. 1. Subject Of The Contract: Electricity, Cpv Code: 09310000-5 Electricity. 1) The Subject Of The Order Is The Successive Supply Of Electricity For The Needs Of The Port Of Gdynia Authority S.A. Confirmed By Guarantees Of Origin Of Renewable Energy Sources. 2) Guarantees Of Origin When Placing An Order Will Apply To: A) 100% Of Energy Purchased For Own Needs; B) 40% Of Energy Purchased For Further Resale. 3) The Contractor Is Obliged To Provide Electricity For Its Own Needs, 100% Of Which Comes From Renewable Energy Sources (Res) And To Provide Electricity For Further Resale, 40% Of Which Comes From Renewable Energy Sources (Res) As Defined In The Act Of February 20, 2015 On Renewable Energy Sources (Consolidated Text: Journal Of Laws Of 2026, Item 68). The Origin Of Energy From Renewable Energy Sources Must Be Confirmed By Valid Guarantees Of Origin Issued By The President Of The Energy Regulatory Office, In Accordance With Applicable Law. Guarantees Of Origin Should Be Submitted To The Ordering Party Within The Deadline Specified In The Agreement, No Later Than Within 120 Days From The End Of Each Half-Year Of The Agreement. The Amount Of Guarantees Of Origin For Each Half-Year Must Be Related To The Energy Actually Purchased In A Given Half-Year. 4) The Subject Of The Order Includes The Supply Of Electricity In The Total Estimated (Projected) Amount: 16,089.799 Mwh. 5) Electricity Supplies Will Be Carried Out: A) For Consumption Points - Specified In Annex No. 4 To The Swz, B) For Own Needs And For Resale, With The Forecast Amount Of Electricity Purchased Specified In Annex No. 3 To The Swz, C) Successively Depending On The Needs Of The Ordering Party, D) With Technical Parameters Consistent With The Provisions Of The European Parliament And The Implementing Regulations Of This Act. 6) The Division Of The Amount Of Electricity In Order To Issue An Invoice For Energy For Own Needs And For Further Resale Will Be Based On The Declaration Provided To The Contractor By The Ordering Party For A Given Settlement Period. 7) Under The Concluded Energy Sales Agreement, The Contractor Is Responsible For Commercial Balancing Of Electricity. 8) The Ordering Party Is Not The Final Buyer Under The Act Of December 6, 2008 On Excise Duty (Consolidated Text: Journal Of Laws Of 2025, Item 126, As Amended). The Contractor Is Obliged To Sell Electricity Free Of Excise Duty To The Ordering Party. 9) The Amount Of Electricity Specified In Point 4) Is An Estimated (Projected) Amount, And The Projected Electricity Consumption Specified In Annex No. 3 To The Swz Is An Element Used To Select The Most Advantageous Offer And Does Not Constitute An Obligation On The Part Of The Ordering Party To Purchase Energy In The Given Amounts. The Contractor Will Not Be Entitled To Any Claims Due To The Ordering Partys Failure To Collect The Forecast Amount Of Energy Or The Amount Exceeding The Forecast Amount. 10) Submission Of An Offer By The Contractor That Is Inconsistent With The Above
