Toll-Collection Services – Providing The Service Of Checking Tickets And Transport Documents On Wkd Trains. 1. The Subject Of The Order Is The Provision Of Ticket And Transport Document Inspection Services On Trains Operated By Warszawska Kolej Dojazdowa Sp. Z O.O. 2. A Detailed Description Of The Subject Of The Order Is Annex No. 2 To The Swz, In Which The Ordering Party Determined The Maximum Scope Of The Subject Of The Order, Subject To Section 3. 3. The Ordering Party Reserves The Right To Exercise The Option Right: 1) The Ordering Party Indicates That The Minimum Scope Of The Subject Of The Order, Hereinafter Referred To As The Basic Scope, Concerns The Implementation Of The Subject Of The Order Referred To In Section Above. 1 Of The Swz And The Description Of The Subject Of The Order Constituting Annex No. 2 To The Swz For A Period Of 12 Months From The Date Of Commencement Of The Service; 2) The Ordering Party Indicates That The Option Right, Hereinafter Referred To As The Option Right, Covers The Implementation Of The Subject Of The Order Referred To In Section Above. 1 Of The Swz And The Description Of The Subject Of The Order Constituting Annex No. 2 To The Swz For The Next 12 Months Following The Basic Scope. 4. The Option Right Will Be Exercised Provided That The Ordering Party Has Secured Financial Resources. The Condition For Exercising The Option Right Is That The Ordering Party Provides The Contractor With A Declaration Of Will To Exercise The Option Right Within The Scope Specified By Him. After 6 Months From The Commencement Of The Basic Order, The Ordering Party Will Submit A Declaration On The Exercise Of The Option Right. 5. If The Ordering Party Does Not Exercise The Option Right, The Contractor Is Not Entitled To Any Claims In This Respect. The Ordering Party Reserves That It Is Not Obliged To Exercise The Option Right. 6. The Contractor Is Obliged To Complete The Order On The Terms And Conditions Described In The Draft Provisions Of The Contract (Ppu) Constituting Annex No. 4 To The Swz. 7. The Ordering Party Does Not Divide The Order Into Parts And Does Not Allow The Submission Of Partial Offers. 8. The Main Subject Of The Order In This Procedure Is A Service Within The Meaning Of Art. 7 Points 28 Of The Public Procurement Law.
