1. The Subject Of The Order Is The Delivery Of Medicinal Products According To 4 Packages To The Headquarters Of The Ordering Party (Kraków, Os. Złota Jesieni 1), In Accordance With The Description And Requirements Contained In Annex 1 To These Specifications.2. Validity Period/Warranty Period Of The Subject Of The Order: Cannot Be Shorter Than 12 Months From The Date Of Delivery, And For Nutritional Preparations - Not Shorter Than Half Of The Expiry Date For A Given Product. Deliveries Of Products With A Shorter Validity Period May Be Allowed In Exceptional Situations And Each Time Consent Must Be Expressed By An Authorized Representative Of The Ordering Party With Confirmation Via E-Mail.3. Only Drugs Included In The National Health Funds Reimbursement Lists Are Allowed In Drug And Chemotherapy Programs (The Price Of The Drug Cannot Exceed The Financing Limit Set By The National Health Fund).4. The Ordering Party Should Include The Form Of The Drug In The Specification, E.G. Tablet Means All Types Of Tablets, And Caps - All Types Of Capsules, Etc. In Other Cases, The Form Of The Drug Is Precisely Defined, E.G. Enteric-Resistant Tablet Means That Only Enteric-Resistant Tablets Are Allowed.5. A Medicinal Product Constituting The Subject Of The Order Should Be Understood As Medicinal Products Within The Meaning Of The Pharmaceutical Law Act Of September 6, 2001 (Consolidated Text: Journal Of Laws Of 2025, Item 750, As Amended). The Offered Medicinal Product Must Be Authorized For Marketing Under The Terms Set Out In Art. 3 Or 4 Section 1 And 2 Or 4A Of The Pharmaceutical Law. The Offered Foodstuffs For Particular Nutritional Uses Must Meet Adequate Requirements And Be Admitted To Trading In Accordance With The Principles Set Out In Particular In The Provisions Of The Act Of August 25, 2006 On Food And Nutrition Safety (Consolidated Text: Journal Of Laws Of 2023, Item 1448, As Amended) And Implementing Acts, Including The Regulation Of The Minister Of Health Of September 16, 2010 On Foodstuffs Intended For Particular Nutritional Uses (Consolidated Text: Journal Of Laws Of 2015, Item 1026).6. The Ordering Party, In The Implementation Of This Order In The Part Concerning The Transport Of The Medicinal Product And Foodstuffs Intended For Particular Nutritional Uses To The Ordering Partys Headquarters, Allows The Participation Of Subcontractors With Authorizations.7. The Remaining Terms Of The Order Are Specified In The Draft Contract Constituting Annex No. 3 To The Specification.
