If The Contractor Has Its Registered Office Or Place Of Residence Outside The Territory Of The Republic Of Poland, Instead Of The Documents Referred To In Section 6.2. Of This Chapter, Submits: A. Information From The National Criminal Register Referred To In Art. 108, Section 1, Point 1 And Point 2 And 4 - Submits Information From An Appropriate Register, Such As A Court Register, Or In The Absence Of Such A Register, Another Equivalent Document Issued By The Competent Judicial Or Administrative Authority Of The Country Where The Contractor Has Its Registered Office Or Place Of Residence Or The Place Of Residence Of The Person To Whom The Information Or Document Relates, B. Instead Of A Certificate Of The Competent Head Of The Tax Office Confirming That The Contractor Is Not In Arrears With The Payment Of Taxes And Fees, Within The Scope Of Art. 109, Section 1, Point 1 Of The Act, Instead Of A Certificate Or Other Document Of The Relevant Local Organizational Unit Of The Social Insurance Institution Or The Relevant Local Branch Of The Agricultural Social Insurance Fund Within The Scope Of Art. 109, Section 1, Point 1 Of The Act, Instead Of An Extract Or Information From The National Court Register Or The Relevant Register Or From The Central Registration And Information On Economic Activity, Within The Scope Of Art. 109, Section 1, Point 4 - Submits A Document Or Documents Issued In The Country Where The Economic Operator Has Its Registered Office Or Place Of Residence, Confirming Respectively That: 1) He Has Not Violated His Obligations Regarding The Payment Of Taxes, Fees Or Social Security Or Health Insurance Contributions, 2) His Liquidation Has Not Been Initiated, Bankruptcy Has Not Been Declared, His Assets Are Not Managed By A Liquidator Or A Court, He Has Not Concluded An Arrangement With Creditors, His Business Activity Is Not Suspended And He Is Not In Any Other Situation Of This Type Resulting From A Similar Procedure Provided For In The Regulations Of The Place Initiating This Procedure. 6.4. If In The Country Where The Economic Operator Has Its Registered Office Or Place Of Residence Or The Place Of Residence Of The Person To Whom The Document Relates, The Documents Referred To In Point 6.2 Point 1 Are Not Issued, Or If These Documents Do Not Refer To All Cases Referred To In Art. 108 Section 1 Point 1, 2 And 4, Art. 109 Section 1 Point 1, 2 Letter A And B And Point 3 Of The Act, They Shall Be Replaced, Respectively, In Whole Or In Part, By A Document Containing, Respectively, A Declaration Of The Contractor, Specifying The Person Or Persons Authorized To Represent Him, Or A Declaration Of The Person To Whom The Document Was To Concern, Made Under Oath, Or, If In The Country Where The Contractor Has His Registered Office Or Place Of Residence Or The Place Of Residence Of The Person To Whom The Document
