1. The Subject Of The Order Are Construction Works Entitled: Renovation Of The Internal Road 02-Kdw, Plot No. 345/1, Precinct 1 Giżycko, Plot No. 345/1, Precinct 0001 City Of Giżycko.2. The Basic Scope Of Works Includes In Particular: A) Earthworks, Preparatory And Accompanying Works, B) Road Renovation, C) Roadside Renovation D) Finishing And Accompanying Works. A Detailed Description Of The Subject Of The Order Is Included In Stwiorb, Which Constitutes Annex No. 9 To The Swz. 3. The Ordering Party Requires Special Care In Carrying Out The Works, In Particular Ensuring Appropriate Security And Protection, Keeping The Construction Site In Good Order, Organizing Construction Works In A Way That Does Not Expose People Using The Given And Neighboring Properties To The Scope Of The Investment Task. Due To The Above, The Contractor Must Include The Costs Of Securing The Performance Of Works In The Offer Price. This Cost Should Be Included In Indirect Costs. 4. The Ordering Party, Pursuant To Art. 95 Of The Public Procurement Law, Requires The Contractor Or Subcontractor To Employ, Under An Employment Relationship, Persons Performing Activities Related To The Execution Of The Order, The Performance Of Which Consists In Performing Work In The Manner Specified In Art. 22 § 1 Of The Act Of June 26, 1974, Labor Code (Consolidated Text: Journal Of Laws Of 2025, Item 277, As Amended). The Above Employment Requirement Based On An Employment Relationship Applies To Manual Workers Directly Performing Construction Works Covered By The Subject Of The Contract In The Scope Of: A) Demolition And Earthworks, B) Road Works (Road), C) Development Of The Area With Greenery, D) Service Machines, Vehicles, Equipment And Devices. The Above Requirement Does Not Apply To Freelancers, Including Designers, Construction Managers And Works Managers. 5. By The Date Of Signing The Contract, The Contractor Is Obliged To Submit A List Of These Persons Along With A Statement Confirming Their Employment Under An Employment Contract, And, At The Request Of The Ordering Party, Evidence Indicating Their Employment Under An Employment Contract. After Concluding The Contract, The Contractor Is Also Obliged, At Each Request Of The Ordering Party, To Submit A List Of Persons Along With A Statement Confirming Their Employment Under An Employment Contract And That They Are Not In Arrears With The Payment Of Remuneration As At The Date Of Submitting The Statement. At Each Stage Of The Implementation Of The Subject Of The Contract, The Ordering Party Has The Right To Demand That The Contractor Prove That People Are Employed Under An Employment Contract. 6. In Case Of Justified Doubts As To Compliance With Labor Law By The Contractor Or Subcontractor, The Ordering Party May Request An Inspection By The National Labor Inspectorate. 7.
