1. The Subject Of The Order Is The Purchase And Successive Delivery Of Water Supply And Sewage Materials For The Implementation Of Investment Tasks And The Ongoing Maintenance Of The Water Supply And Sewage Network By The Municipal Plant In Kruśliwiec. 2. Water Supply And Sewage Materials Provided By The Contractor Must: 1) Meet The Requirements Specified In The Act Of April 16, 2004 On Construction Products (Consolidated Text: Journal Of Laws Of 2021, Item 1213); 2) Be Brand New, Unused, Of Appropriate Type And Quality, Free From Defects And Damage, Not Subject To Third Party Rights And Covered By The Contractors Warranty Granted For A Period Specified In The Offer;3) Have The Legally Required Certificates, Approvals, Declarations Of Performance, National Declarations Of Performance, Declarations Of Conformity Or Other Documents Required By Law, Confirming The Admission Of The Materials To Marketing And Use In The Territory Of The Republic Of Poland. The Contractor Will Provide The Ordering Party With Documents Regarding The Actually Delivered Materials No Later Than On The Day Of Their Delivery; 4) Be Selected In Accordance With The Principles Of Technical Knowledge And Construction Practice And Be Appropriate To The Type Of Works Performed And The Purpose For Which They Were Produced; 5) If, Before The Delivery Of Materials, Documents Confirming The Admission Of The Offered And Priced Materials To Trading And Use In The Territory Of The Republic Of Poland, In Particular Certificates, Attestations, Declarations Of Performance, National Declarations Of Performance, Declarations Of Conformity, National Or European Technical Assessments Or Other Documents Required By Law Become Invalid, Withdrawn Or Expire, The Contractor Is Obliged To Immediately Inform The Ordering Party And Obtain Its Approval And Submit Current Documents Regarding The Same Material. If, For Reasons Beyond The Control Of The Contractor, It Is Not Possible To Submit Current Documents For This Material, The Use Of Equivalent Material May Only Be Made In Accordance With The Principles Set Out In § 8 Section 3 Point 2 Of The Contract.3. The List Of Water Supply And Sewage Materials Covered By The Subject Of The Order, Along With Their Expected (Estimated) Quantities, Is Set Out In Annex No. 1 To The Terms Of Reference (Swz). The List Includes In Particular Water Supply Fittings, Hydrants, Gate Valves, Pehd And Pvc Pipes, Water Supply And Sewage Fittings, Wells, Manholes And Accessories For The Operation Of Water Supply And Sewage Networks. The Quantities Given In The Assortment And Price Form Are Estimates And Are Used Only To Compare Offers And Determine The Maximum Scope Of The Order. The Ordering Party Reserves The Right To Change The Quantity Of Individual Product Items Indicated In The Form. Assortment And Price, Depending On The Actual Needs, Maintaining The Unit Prices Specified In The Contractors Offer And Provided That The Total Value Of Completed Deliveries Does Not Excee
