1. The Subject Of The Order Is The Implementation Of An Investment Called Modernization Of The Landing Strip Of The Józef Strus Multi-Specialty Municipal Hospital In Poznań. The Subject Of The Order Includes, Among Others: 1) Development Of Design Documentation, Including Construction, Technical And Executive Design; 2) Bioz Plan; 3) Stwior; 4) Execution Of Construction Works. 2. A Detailed Description Of The Subject Of The Order Is Annex No. 1 To Swz, Which Includes, Among Others, The Functional And Utility Program (Hereinafter: Pfu).3. The Ordering Party Stipulates That When Describing The Subject Of The Contract By Reference To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Act, Allows Solutions Equivalent To Those Described, And Such A Reference Is Accompanied By The Words Or Equivalent Even Despite The Possible Lack Of A Phrase In The Description Of The Subject Of The Contract.4. Whenever This Swz Content, Within The Scope Of The Description Of The Subject Of The Contract, Mentions Trademarks, Proper Names, Etc. - They Constitute Only A Qualitative, Functional, Technical And Technological Standard Relating To The Subject Of The Contract. In All Cases Where, Due To The Specification Of The Subject Of The Order, The Names Of Materials, Devices Or Their Origin Are Indicated, The Use Of Equivalent Materials, Devices Is Allowed, I.E. Any Materials, Devices Mentioned By Name Used In The Documentation Provided By The Ordering Party Or Their Origin, Serve Only To Determine The Standard And May Be Replaced By Others With No Worse Technical, Functional, Qualitative, Functional And Aesthetic Parameters, Taking Into Account Proper Cooperation With Other Materials, Devices. The Names Used In The Order Documentation That Indicate Or Could Be Associated With A Manufacturer Or Company Are Not Intended To Favor The Solutions Of A Given Manufacturer, But To Indicate A Solution That Should Have Technical And Technological Features Not Worse Than Those Provided In The Technical Documentation. In The Case Of Offers Containing Equivalent Solutions, The Ordering Party Will Verify Them In Terms Of Meeting The Requirements Of Individual Items Of Technical Requirements Contained In The Annexes To The Swz. The Contractor Is Obliged To Prove In The Offer The Equivalence Of The Offered Devices Or Systems. The Burden Of Proving Equivalence Is The Responsibility Of The Contractor. The Ordering Party Will Not Accept Equivalent Solutions If They Have Lower Quality, Functional, Technical And Technological Requirements Than Those Indicated In The Annexes To The Swz.5. When Included In Design Documents, Technical Specifications Or Other Documents, The Manufacturers Names Mentioned (If Any) Are Used For Illustrative Purposes Only.
