Document Management Software Package – Delivery Of Standard Software With Licenses, Update Rights And Subscriptions. 1. The Subject Of The Order Is The Supply Of Standard Software With Licenses, Update Rights And Subscriptions. A Detailed Description Of The Subject Of The Order Is Attached As Appendix No. 1 To The Swz (Hereinafter Abbreviated As: Opz). 2. The Order Consists Of The Basic Scope And The Option Right: A) The Basic Scope Includes Delivery And Activation Of The Subscription, Where The First Subscription Period Begins On November 1, 2026. If This Contract Is Concluded After November 1, 2026, The First Subscription Period Begins Within 3 Business Days From The Date Of Signing The Contract By Both Parties. Subsequent Subscription Periods Begin Immediately After The Expiry Of The Previous Period, With The Total Subscription Duration Being 36 Months, B) The Option Right Covers Additional Deliveries Of Products In The First Subscription Period And The Second Subscription Period. 3. Wherever The Ordering Party, When Describing The Subject Of The Order In The Swz And Opz, Used Trademarks Or Other Terms Characterizing Products Delivered By A Specific Contractor, This Means, In Accordance With Art. 99 Section 5 Of The Public Procurement Act, That It Is Justified By The Specificity Of The Subject Of The Contract And The Ordering Party Cannot Describe The Subject Of The Contract In A Sufficiently Precise And Understandable Way. In Such Circumstances, The Ordering Party Allows For The Possibility Of Offering Equivalent Products And, When Assessing Equivalence, Will Be Guided By The Criteria Indicated In The Opz (Point 4 - Conditions Of Equivalence - Technical And Operational Specification And Functional Features Of The Products). The Burden Of Demonstrating That The Offered Products Equivalent To Those Described By The Ordering Party Meet The Ordering Partys Requirements Rests With The Contractor - In This Respect, The Ordering Party Requires The Submission Of The Said Evidence Along With The Offer In Accordance With The Content Of Chapter Via Of The Swz. Wherever The Subject Of The Contract Is Described By Reference To Standards, In Accordance With Art. 101 Section 4 Of The Public Procurement Law, The Ordering Party Allows Solutions Equivalent To Those Described. Pursuant To Art. 101 Section 5 Of The Public Procurement Law, The Contractor Who Refers To Equivalent Solutions Described By The Ordering Party Is Obliged To Prove In The Offer, In Particular By Means Of Evidence Referred To In Art. 104-107 Of The Public Procurement Law, That The Proposed Solutions Equally Meet The Requirements Specified In The Description Of The Subject Of The Contract. The Rules In Accordance With Chapter Via Of The Swz Apply. Detailed Equivalence Conditions Are Described In The Opz. 4. The Ordering Party Requires Contractors Who Offer Equivalent Products To: A) Indicate In The Content Of The Offer The Offered Equivalent Product In The Manner And At The Level Of Detail Specified In The Order Documents, B) Confirm The Equivalence Of The Offered Products By Indicating Them In The Offer Form And Demonstrating That The Offered Products Meet All The Criteria For Assessing Equivalence Described In The Tor, C) Submitting With The Offer One Copy Of The Offered Equivalent Product (These May Be License
