Cloaks – Cloak Delivery. 1. The Subject Of The Order Is The Delivery Of: - As Part Of The Basic Order, 700 Pieces Of Coats (Womens And Mens); - Under The Right Of Option, Up To A Maximum Of 700 Pieces Of Coats (Womens And Mens). 2. The Subject Of The Order Was Specified In The Common Procurement Vocabulary And Marked With The Cpv Code: 18212000 -8- Coats. 3. As Part Of The Execution Of The Order, The Ordering Party Provides For The Possibility Of Exercising The Option Right On The Terms Specified In The Swz. The Item Covered By The Optional Order Will Be Identical To The Item Covered By The Basic Order. 4. The Ordering Party Does Not Allow The Submission Of Partial Offers. In The Proceedings In Question, Dividing The Order Into Parts Would Result In An Automatic Increase In The Unit Price Of The Coat (Due To The Increase In Production Costs), Which Would Consequently Lead To An Increase In The Costs Of Completing The Entire Order. Such Action Would Be Contrary To The Public Finance Act. 5. The Net Unit Prices Of The Delivery Item Under The Basic Order And Under The Option Order Will Be The Same. 6. The Item Delivered As Part Of The Order Must Comply With The Requirements Of The Ordering Party And Must Be New And Must Come From Current Production. 7. The Ordering Party Will Inform The Contractor In Writing In A Separate Statement About Its Intention To Exercise The Option Right, No Later Than 30 Days From The Date Of Signing The Contract. In The Statement, The Ordering Party Will Provide The Final Number And Dimensions Of The Subject Matter Of The Contract Ordered Under The Option Law. 8. The Ordering Partys Requirements Are Specified In Detail In The Descriptions Of The Subject Of The Order (Technical Specifications) Constituting Annex No. 1 A And 1B To This Swz, Respectively, And In The Draft Agreement Constituting Annex No. 3 To The Swz. 9. After Signing The Contract, Before Starting Target Production, The Contractor Will Provide The Ordering Party With A Sample Of The Subject Of The Contract (2 Copies) In The Size Specified By The Ordering Party, Together With The Required Documents - Within 45 Days From The Date Of Signing The Contract. Detailed Information Is Included In § 2 Of The Draft Agreement, Constituting Annex No. 3 To The Swz. 10. Due To The Fact That The Author Of The Description Of The Subject Of The Order (Technical Specification) Of The Womens And Mens Coats Is The Institute Of Security Technology Moratex Based In Łódź (90-505) At Ul. Marii Skłodowska - Curie 3, The Contractor Will Be Obliged To Conclude The Above-Mentioned Institute Of A Paid, Non-Exclusive License Agreement In Accordance With § 3 Section 2 Of The Draft Contract Specified In Annex No. 3 To The Swz. 11. The Minimum Required Warranty Period For Each Item Of The Order Is 24 Months From The Date The Item Is Released From The Warehouse For Use, While The Period Of Its Storage By The Ordering Party In The Warehouse Is A Maximum Of 5 Years. If The Item Is Released For Use After The Expiry Of Its Storage Period, The Warranty Is Not Valid (Extension Of The Warranty Period Granted For The Subject Of The Order Is One Of The Criteria For Evaluating Offers).
