1. Part 1 Titled Nursery No. 3 Includes The Delivery (Purchase + Transport + Bringing + Assembly) Of Furniture For The Municipal Nursery No. 3 In Bytom, Ul. Strzelców Bytomskich 248A In The Quantity And Parameters Included In The Description Of The Subject Of The Order. By Submitting An Offer, The Contractor Grants The Ordering Party A 24-Month Warranty For The Delivered Subject Of The Order, Under The Conditions Specified In The Draft Contractual Provisions. The Contractor May Offer A Longer Warranty Period, Which Will Be Assessed As Part Of The Offer Evaluation Criteria. If The Ordering Party Has Indicated In The Description Of The Subject Of The Order Trademarks, Patents Or Origin, Sources Or A Specific Process That Characterizes The Products Or Services Provided By A Specific Contractor, It Is Allowed To Offer Solutions Equivalent To Those Described, Provided That They Maintain The Same Minimum Technical, Quality And Functional Parameters, Etc. 2. The Contractor Who Refers To Equivalent Solutions Is Obliged To Demonstrate That The Solution He Offers Meets The Requirements Specified By Ordering Party. In Such A Case, The Contractor Attaches To The Offer A List Of Equivalent Solutions Along With Its Description Or Standards.3. If The Description Of The Subject Of The Contract Includes References To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2) And Section 3 Of The Public Procurement Law, The Ordering Party Allows Solutions Equivalent To Those Described.4. The Ordering Party Does Not Reserve The Obligation For The Contractor To Personally Perform A Key Part Of The Order. The Contractor May Entrust The Execution Of Part Of The Order To A Subcontractor. The Contractor Should Indicate In The Offer The Parts Of The Order Whose Performance He Intends To Entrust To Subcontractors And Provide The Names Of Any Subcontractors, If They Are Already Known. Entrusting The Performance Of Part Of The Order To Subcontractors Does Not Release The Contractor From Responsibility For The Proper Performance Of The Order.
