1. The Subject Of The Agreement Is The Reconstruction And Modernization Of The Sanitary Facility At The Support And Rehabilitation Center For Disabled People (Owiron) At Ul. Rozłogi 10 In Warsaw.2. The Detailed Description Of The Subject Of The Order Is Annex No. 1 To The Swz, Additional Information Is Included In The Design Documentation (Architectural Design, Electrical Installation Design, Sanitary Installation Design, Bill Of Quantities, Technical Specifications For The Execution And Acceptance Of Construction Works And Documents Constituting Annexes To The Design Documentation). The Design Documentation Constitutes Annex No. 15 To Swz.3. The Bill Of Quantities Is An Auxiliary Material For Calculating The Offer Price, Which Should Take Into Account Any Discrepancies In The Number Of Works Between The Bill Of Quantities And The Technical Documentation And Technical Specifications. The Cost Of Performing Works, The Quantity Of Which Has Been Understated In The Bill Of Quantities Or Omitted Therein And Appears In The Documentation Or In This Description Of The Subject Of The Order Or In The Content Of The Agreement, Constitutes The Risk Of The Contractor And Will Be Considered Included In The Lump Sum Price Of The Offer And Therefore In The Contractual Remuneration. The Contractor Is Obliged To Carefully Check, Analyze And Calculate The Number Of Works To Be Performed According To The Documentation. Failure To Indicate In The Bill Of Quantities The Works Necessary To Be Performed, Resulting From The Design Documentation, Does Not Release The Contractor From The Obligation To Perform Them As Part Of A Lump Sum Remuneration. The Contractor Is Obliged To Calculate The Lump Sum Remuneration Based On Technical Knowledge, Technical Documentation, And Its Own Assessment, Taking Into Account All The Work Necessary To Perform The Subject Of The Contract4. Pursuant To Art. 95 Of The Public Procurement Act, The Ordering Party Determines The Requirements Related To The Implementation Of The Order In Terms Of Employment By The Contractor Or Subcontractor Based On The Employment Relationship Of Persons Performing The Activities Specified By The Ordering Party In The Scope Of Contract Execution, If The Performance Of These Activities Involves Performing Work In The Manner Specified In Art. 22 § 1 Of The Act Of June 26, 1974 - Labor Code (Journal Of Laws Of 2025, Item 277, As Amended), I.E. The Ordering Party Requires The Contractor Or Subcontractor To Employ, On The Basis Of An Employment Relationship, Persons Performing Activities During The Execution Of The Order In The Field Of Masonry Works, Finishing Works, Electrical Installation Works, Sanitary Installation Works. The Ordering Party Specifies In The Draft Provisions Of The Contract, Constituting Annex No. 2 To The Swz: 1) The Method Of Verifying The Employment Of These People, 2) The Ordering Partys Rights In Terms Of Monitoring The Fulfillment Of The Requirements By The Contractor 5.
