The Subject Of The Contract Is The Provision Of Services Of A Patent Attorney In The Scope Of Conducting New And Continuation Of Ongoing Patent Proceedings Before The Patent Office Of The Republic Of Poland (Uprp) And Patent Offices Outside The Country, For Inventions Filed Under The National, International Pct (Patent Cooperation Treaty) And European Epo (European Patent Office) Procedures For The University Gdańsk, Hereinafter Referred To As The Service. 2. Common Procurement Vocabulary (Cpv) Classification Code: 79120000-1 (Patent And Copyright Consultancy Services). 3. A Detailed Description Of The Subject Of The Contract Is Set Out In Annex No. 6 To The Swz - Description Of The Subject Of The Contract. 4. Place Of Service: Technology Transfer Center Of The University Of Gdańsk, Ul. Wita Stwosza 63, Faculty Of Chemistry F, The Contractors Registered Office And Remote Work - Online, As Well As Appearance Before Patent Offices In Poland And Other Countries, To The Extent Covered By The Contract Regarding This Order. 5. The Contractor Is Obliged To Carry Out The Full Scope Of This Order With Due Diligence, In Accordance With The Terms Of The Procedure Described In The Swz, Including Taking Into Account The Requirements Specified In The Draft Contract (Annex No. 5 To The Swz) Together With Annexes, In Accordance With Applicable Law, Including The Provisions Of The Act Of April 11, 2011 On Patent Attorneys (Consolidated Text: Journal Of Laws Of 2024, Item 749, As Amended), Generally Accepted Knowledge In This Area, The Contractors Offer And The Arrangements With The Ordering Party. 6. The Ordering Party Informs That The Quantities Of Individual Services Given In The Price Form - Annex No. 1A To The Swz Are Forecasted (Estimated) Quantities, Not Binding On The Ordering Party And May Be Changed, Which Will Not Constitute An Amendment To The Contract. The Actual Number Of Individual Services Ordered By The Ordering Party Will Result From Its Current Needs, And The Total Gross Remuneration Of The Contractor Will Not Exceed The Amount Specified In § 3 Section 1 Of The Draft Contract - Subject To Possible Changes Specified In § 11 Of The Draft Contract. 7. The Ordering Party Reserves The Right To Resign From The Execution Of Part Of The Order, Up To A Maximum Of 20% Of The Gross Value Of The Contractors Remuneration Referred To In § 3 Section 1 Draft Contract. In Such A Case, The Contractor Is Not Entitled To Any Claims Against The Ordering Party, In Particular A Claim For Performance Of The Contract Up To The Full Amount Or For Payment Of Remuneration For The Unrealized Part Of The Order. The Planned Resignation Results In A Corresponding Reduction In The Final Value Of The Remuneration Due To The Contractor And Does Not Constitute An Amendment To The Contract Requiring The Conclusion Of An Annex. 8. The Ordering Party Informs That During The Implementation Of The Contract There May Be Orders That Will Be Paid For From Eu, Foreign And Domestic Projects - The List Of Projects Is Included In Annex No. 9 To The Swz. 9.
