Subject Of The Order The Subject Of The Order Is The Non-Cash Purchase Of Liquid Fuels And Adblue At The Contractors Gas Stations For The Needs Of The Water And Sewerage Management Plant In Tomaszów Mazowiecki Sp. Z O. O. The Subject Of The Order Is Carried Out For The Purposes Of Carrying Out Sectoral Activities And Activities Related To Waste Management - By The Water And Sewage Management Plant In Tomaszów Mazowiecki Sp. Z O. O. The Purchase Concerns Vehicles At The Ordering Partys Disposal, Marked With The Zgwk Symbol. Estimated Quantities: A) 237,000 Liters Of Diesel Oil (On) B) 2,500 Liters Of Pb95 Unleaded Petrol C) 8,500 Liters Of Adblue Liquid The Given Quantities Are Estimates And May Change During The Execution Of The Contract. A Change In Quantity Does Not Constitute The Basis For The Contractors Claims Against The Ordering Party. 2. Detailed Requirements For The Implementation Of The Subject Of The Order And The Conditions For The Sale Of Fuel Are Specified In The Contract Template (Appendix No. 4 To The Swz). 3. Place Of Execution Of The Order The Contractor Is Obliged To Ensure The Possibility Of Refueling The Ordering Partys Vehicles At At Least One Publicly Accessible Gas Station: • Located Within The Administrative Boundaries Of The Municipality Of Tomaszów Mazowiecki, Open 24 Hours A Day, 7 Days A Week. The Location Requirement Results From The Need To Ensure Continuity Of The Ordering Partys Tasks And To Optimize The Costs And Travel Time Of Vehicles That Move Mainly Within The City And Its Immediate Vicinity. The Requirement To Ensure Continuous Refueling Of Vehicles Within The Administrative Boundaries Of The Commune Of Tomaszów Mazowiecki Is Caused By A Justified And Objective Reason Related To The Fact That All Vehicles Intended To Carry Out The Companys Tasks Move Within The Administrative Boundaries Of The Commune Or At A Short Distance Beyond It, Therefore It Would Be Unjustified, Irrational And Uneconomical From The Ordering Partys Point Of View For The Ordering Party To Make A Purchase From A Contractor Who Is Based Outside This Area. If The Contractor Indicates A Gas Station Located Outside The Area Referred To Above, The Offer Will Be Rejected On The Basis Of Art. 226 Section 1 Point 5 Of The Public Procurement Law - Its Content Is Inconsistent With The Terms Of The Order. This Is Repeatedly Confirmed By The Case Law Of The National Chamber Of Appeal (E.G. Kio 732/11 Kio 496/15) - The Ordering Party Has The Right To Determine The Place Of Performance Of The Service/Delivery, Provided That The Above Circumstance Should Take Into Account Its Specificity, Existing Market Realities And Potential Contractors Interested In Participating In The Proceedings. According To The Knowledge That The Ordering Party Has Within The Administrative Boundaries Of The Commune Of Tomaszów Mazowiecki, There Are At Least 8 Entities That Can Provide The Service Described In The Subject Of The Order. Therefore, We Cannot Talk About Narrowing The Circle Of Contractors Through Objectively Formulated Provisions Of The Swz. It Should Be Emphasized That The Ordering Party Has The Right To Define The Subject Of The Contract In Such A Way As To Achieve The Expected Effect, I.E
