1. The Subject Of This Public Procurement Is: Construction Works2. The Scope Of The Subject Of The Order Includes: 1) Preparatory And Demolition Works, 2) Earthworks; 3) Drainage Of The Road Body, 4) Construction Of The Substructure And Surface, 5) Road Markings And Road Safety Devices, 6) Construction Of Street Elements, 7) Finishing Works, 8) Other Works, 3. A Detailed Description Of The Subject Of The Order Is Specified In: 1) Auxiliary Cost Estimate - Annex No. 11 To Swz2) Drawing Documentation - Annex No. 12 To Swz3) Change In Permanent Traffic Organization - Annex No. 13 To Swz4. Detailed Technical Conditions For The Execution Of Works Are Specified In: Detailed Technical Specification (Sst) - Annex No. 14 To Swz.5. Whenever References To Standards, European Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Public Procurement Law, The Contractor Should Assume That Such A Reference Is Accompanied By The Words Or Equivalent. If References To Standards, European Technical Assessments, Technical Specifications And Technical Reference Systems Are Used In The Design Documentation, The Ordering Party Allows Solutions Equivalent To Those Described. When Analyzing The Design Documentation, The Contractor Should Assume That Each Reference Used In The Design Documentation Is Accompanied By The Word Or Equivalent. If Trademarks Are Used In The Design Documentation Or Technical Specification For The Execution And Acceptance Of Works, It Means That They Are Provided As Examples And Define Only The Minimum Expected Quality Parameters And The Required Standard. The Contractor May Use Equivalent Materials Or Devices, But With Similar Or Better Technical And Quality Parameters, The Use Of Which Will In No Way Adversely Affect The Proper Functioning Of The Solutions Adopted In The Design Documentation. The Contractor Who Uses Equivalent Devices Or Materials Will Be Obliged To Demonstrate During The Execution Of The Order That The Devices And Materials Used By Him Meet The Requirements Specified By The Ordering Party. The Use Of A Label In The Design Documentation Means That The Ordering Party Accepts All Labels Confirming That Given Construction Works, Supplies Or Services Meet The Equivalent Requirements Of The Label Specified By The Ordering Party. If The Contractor, For Reasons Beyond Its Control, Cannot Obtain The Label Specified By The Ordering Party Or An Equivalent Label, The Ordering Party, Within The Deadline Set By Itself, Accepts Other Appropriate Means Of Evidence, In Particular The Manufacturers Technical Documentation, Provided That The Contractor Proves That The Construction Works, Supplies Or Services To Be Performed By It Meet The Requirements Of The Specific Label Or Specific Requirements Indicated By The Ordering Party. 6. The Use In The Design Documentation Of The Requirement To Have A Certificate Issued By A Conformity Assessment Body Or A Report
